This call has as its object the assignment of insurance services in favor of the Province of Lucca divided into the following lots:

Lot 1 – Civil liability towards third parties and workers (RCT /RCO) basic auction amount € 960,000.00

Lot 2 - All risks real estate and furniture basic auction amount € 360.000,00

Lot 3 - Legal Protection basic auction amount € 36.000,00

Lot 4 - Accidents basic auction amount € 18.000,00

Lot 5 – Kasko basic auction amount € 6.000,00

Lot 6 – R.C.Auto registration book basic auction amount € 270.000,00

The object of lot 1 is as follows:

A. Insurance against civil liability towards third parties (R.C.T.): The winning company undertakes to hold the Insured harmless of what he is required to pay, as civilly liable under the law, by way of compensation (capital, interest and expenses) for damages involuntarily caused to third parties, for death, personal injury and damage to property, as a result of an event that occurred in relation to the exercise of the activity described in the policy, also as a result of non-compliance, violation or misinterpretation of legal obligations or regulatory provisions.

B. Insurance against civil liability towards workers (R.C.O.) – including biological damage: The contracting company undertakes to hold the Insured harmless of what he is required to pay (principal, interest and expenses) as civilly responsible:

1) pursuant to Articles. 10 and 11 of Presidential Decree no. 1124 of 30 June 1965 and legislative decree no. 38 of 23 February 2000, for accidents (excluding occupational diseases) suffered by workers employed by him and by parasubordinate workers, involved in the activities for which insurance is provided, including accidents "in itinere";

2) pursuant to the Civil Code, by way of compensation for damages not falling within the discipline of the aforementioned Presidential Decree 1124/65 and Legislative Decree 38/2000, or exceeding the services provided by the same, caused to the workers referred to in paragraph 1 above), for death or personal injury.

The subject of the insurance coverage of the All Risks real estate and movable property policy is specified in detail in the special tender specifications of lot 2.

The winning company assumes at its own expense, up to the amount of the agreed guarantee ceiling, the costs of appraisal, assistance, legal aid and defense, out of court and judicial, in every state and degree, which should be borne by the Insured - indicated in the policy sheet - to protect their interests as a result of acts or facts of the natural persons insured, directly related to the performance of the respective mandate or service and the performance of the official tasks carried out on behalf of the Contractor, as better specified in the special tender specifications.

The competitor must be in possession of the requirement of economic and financial capacity and precisely in the three years prior to the publication of the contract (data deducible from the last 3 approved financial statements) a total premium collection in the non-life classes of the RCT not less than € 5,000,000.00 before taxes and / or any other charge

The insurance is provided for accidents that the Insured suffers in the exercise of activities and in the performance of the main and secondary professional functions better described in the technical policy sheets, and / or during the performance of any assignment inherent to the service and / or the mandate conferred on him and / or on the occasion of command / posting / use to other Public Bodies on behalf of the Contractor, as better specified in the special tender specifications.

The Company indemnifies, within the limits and under the following conditions, the material and direct damage suffered by the Insured - even if deriving from gross negligence of the same - for the damage or loss of the insured vehicle, resulting from the events indicated in the special tender specifications and as better indicated in the specifications themselves.

The successful tenderer, in accordance with the rules of the Insurance Code, insures the risks of civil liability for which insurance is mandatory, undertaking to pay - within the agreed limits - the sums that, for capital, interest and expenses, are due as compensation for damage involuntarily caused to third parties - including passengers transported, whatever the title under which the transport was carried out - from the circulation of vehicles described in the Registration Book that forms an integral part of the contract on the effective date of the insurance or subsequently included in the period of validity of the same. The insurance also covers liability for damage caused by the circulation and/or parking of vehicles in private areas.
