Description:
Purchase of electricity for the buildings of the National Museum in Poznań

1. The subject of the contract is the purchase of electricity for the facilities of the National Museum in Poznań, in accordance with the provisions of the Act of 10 April 1997. Energy Law (i.e. Journal of Laws of 2022, item 1385, as amended).

2. The total estimated electricity consumption [MWh] in the period 01.01.2024 – 31.12.2024 is 4,033.641 MWh.

3. The estimated electricity consumption is indicative. It is only used to determine the estimated value of the order and to compare the bids submitted. It does not constitute an obligation of the Contracting Authority to purchase electricity in the specified quantity, and the Contractor is not entitled to any claims in this respect.

4. The actual amount of electricity consumed by the Contracting Authority will be determined and settled on the basis of indications of metering and billing systems at electricity consumption points according to the unit prices specified in the offer, which will be valid throughout the term of the agreement.

4. The actual amount of electricity consumed by the Contracting Authority will be determined and settled on the basis of indications of metering and billing systems at electricity consumption points according to the unit prices specified in the offer, which will be valid throughout the term of the agreement.

5. The settlement period for the electricity consumed will be the same as the settlement period applied to the Contracting Authority's electricity consumption points by the Distribution System Operator. For full legibility of the invoices issued, the settlement periods must coincide with the periods of readings made by the Distribution System Operator for individual electricity consumption points.

6. The detailed scope and manner of performance of the subject matter of the contract is specified in the Draft Provisions of the Agreement (hereinafter referred to as the PPU), constituting Appendix No. 8 to the Terms of Reference together with Appendix No. 1 (list of electricity consumption points covered by the Agreement) and No. 2 (power of attorney) and the Description of the Subject of the Contract (hereinafter referred to as the OPZ) constituting Appendix No. 1 to the Terms of Reference.

7. The Contractor is obliged to submit a statement in the Offer Form, constituting Appendix No. 2 to the Terms of Reference, that in the event of selecting its offer and signing the contract, it will have concluded or will conclude before the date of signing the agreement with the Contracting Authority a general distribution agreement with the Distribution System Operator, i.e. Enea Operator Sp. z o.o., enabling the sale of electricity to the Contracting Authority's electricity consumption points via the Operator's local distribution network Distribution System in the period from 01.01.2024 to 31.12.2024.

8. As part of the performance of the subject matter of this contract, the Contractor acts as the Entity Responsible for Commercial Balancing for electricity sold to the Contracting Authority's electricity consumption points. Commercial balancing is understood as reporting to the electricity transmission system operator by the entity responsible for commercial balancing for the performance of electricity sale agreements concluded by system users and settling with them the difference between the actual amount of electricity supplied or consumed and the amounts specified in these agreements for each settlement period.

9. All costs related to commercial balancing and preparation and reporting of electricity demand schedules to the Distribution System Operator and the Transmission System Operator shall be borne by the Contractor. The costs resulting from balancing are included in the price of electricity.

10. The Contractor undertakes to provide the Contracting Authority with service quality standards in accordance with the applicable provisions of the Energy Law.
