The subject of the contract is the removal and transport services to places authorized by law, municipal waste (including, among others, furniture and bulky waste, tires, green waste, electrical and electronic equipment, debris (in accordance with category 200399) and others), with places not intended for their storage and storage, and abandoned on real estate managed by the Employer in the city of Katowice (all OEB).
1. The subject of the contract is the removal and transport services to places authorized by law, municipal waste (including, among others, furniture and bulky waste, tires, green waste, electrical and electronic equipment, debris (in accordance with category 200399) and others) , from places not intended for their storage and storage, and abandoned on real estate managed by the Employer in the city of Katowice (all OEB). The maximum amount of waste to be cleared is 1,400 m
2. The minimum amount of waste (including debris, tires, green waste, home electronics and appliances) for one collection will be from about 1 m
3. The implementation of waste removal services will be carried out depending on the needs of the Employer, each time based on a separate order, which will be issued at least 24 hours in advance, and the deadline will be not less than 2 business days (not applicable to emergency orders that are to be carried out be immediately, not later than 4 hours from receiving the notification by phone, SMS, fax or e-mail). The contracting authority provides for no more than 3 emergency services per year.
4. The waste to be removed (including furniture, home electronics and appliances, debris, tires, green waste) will be located at ground level. The contracting authority cannot exclude that the waste to be removed will be located in courtyards with difficult access, because it is impossible to predict where the waste will be abandoned. Thus, it is not possible to predict how many orders will relate to such situations.
5. The Awarding Entity anticipates that debris will constitute about 25% of the waste to be removed.
6. Employment requirement under an employment contract. The Employer requires employment by the Contractor or subcontractor on the basis of an employment contract, within the meaning of art. 22 §1 of the Act of 26.6.1974 - Labor Code (Journal of Laws of 2019, item 1040, as amended) of persons performing activities falling under the so-called Direct costs. This requirement applies to persons (manual workers) who perform activities directly related to the performance of services consisting in particular of collecting waste, loading waste, unloading waste, securing waste against dumping, and storing waste. The requirement does not apply to, inter alia, natural persons conducting business activity, office members of the Contractor's management or supervisory bodies, partners of a partnership or partnership, to the extent that they will personally perform services for the Employer or the Contractor. Control method and sanctions related to non-compliance with the abovementioned requirements are described in the contract template (Annex 3 to the ToR).
5. A detailed description of the subject of the contract, regarding the procedure for implementation, implementation, settlement is set out in the Contract Template with Annexes constituting Annex 3 to the ToR.
6. The term of the contract: until 31.12.2020 or until the funds referred to in § 5 para. 3 lit. a template of the contract constituting Annex 3 to the ToR (in case of exercising the option right). The service will commence on the date: from the day the contract is signed.
