The subject matter of this framework agreement is the purchase of the right to use Nutanix software licenses, products and services.

The contracting authority does not divide the procurement into lots because the subject-matter of the contract is licences for products that function functionally together or are necessary to achieve the same objective.

The evaluation of tenders shall be carried out on the basis of the most economically advantageous tender. In the event of equal evaluation results, the contracting authority shall give preference to the tenderer who submitted the tender first by date and time in the public procurement register when selecting the successful tender.

The contracting authority has the right to reject tenders in accordance with the provisions of § 115 and § 116 of the RHS.
