The subject of the contract is the purchase of electricity by the Ordering Authority and their organizational units with a total estimated volume of 30 526.8 MWh (+/- 10%) during the supply period, i.e. from 01.01.2022 to 31.12.2022.

2. The Contractor shall make all the actions and arrangements with the DSO necessary to carry out the procedure to change the seller and effectively start the sale of electricity, including in particular the notification to the DSO of new contracts for the sale of electricity. These actions shall be carried out by the Contractor on the basis of the relevant powers of attorney granted with the conclusion of contracts for the sale of electricity.

Energy sales will be carried out on the basis of contracts concluded separately by individual Contractors and in the case of Territorial Local Government Units also under contracts concluded separately by local government organisational entities, which will be separate payers, and which are detailed in Annex 2 to SWZ.
4. The sale of electricity will be carried out under the terms laid down by the Energy Law Act of 10 April 1997 (Journal of Laws of 2021, item 716 as of late) and on the basis of the implementing provisions of that Act, in particular the regulation of the Minister of Economy of 4 May 2007 in on the detailed conditions for the operation of the electricity system (Journal of Laws No. 93, item 623, as amended), Regulation of the Council of Ministers of 23 July 2007 on detailed rules and modalities for placing restrictions on the sale of solid fuels and the supply and consumption of energy electricity or heat (Journal of Laws No. 133, item 924), Regulation of the Minister of Energy of 6 March 2019 on detailed rules for the formation and calculation of tariffs and billing in the trading of electricity (Journal of Laws item 503 as amended), the rules laid down in the concessions, in accordance with the provisions of the provisions terms of the contract and also in accordance with the offer of the Contractor and in accordance with the provisions of the Civil Code.
5. In this tender step, all energy consumption points (PPE) are divided into 2 groups for which the Ordering Party expects to differentiate the unit prices of electricity submitted in the offer. The expected differentiation is due to the differing profile of energy consumption in these groups.
Characteristics of the separated groups:
Group 1 Street lighting All street lighting objects whose work is controlled automatically by systems based on astronomical clocks or photoelectric devices. The facilities may belong to the tariff groups of the OSD: Bxx, Cxx, O1x, R.
Group 2 Venues and objects other than street lighting All other objects not part of Group 1 belonging to distribution tariff groups: Bxx, Gxx, C1x, C2x, R
