The subject of this contract is the purchase of electricity, in accordance with the provisions of the Act of 10 April 1997, Energy Law (hereinafter: EP) by the Contracting Authority and other entities, for their buildings and infrastructure (in accordance with their fixtures) or for infrastructure, in to which the Contracting Authority or indicated entities are party to the distribution agreement. This order does not include electricity distribution services. The quality parameters of electricity are defined by the Regulation of the Minister of Economy of 4 May 2007 on the detailed conditions for the operation of the electricity system. The order covers the sale of energy in the period 1.1.2022 to 31.12.2023 for objects in annexes No 1.1 to 1.14 to SWZ.

The Contracting Authority informs that:

— During the period of the contract for the contract in question, the Contracting Authority will fulfil the order according to the needs of the Contracting Authority, which is not possible to determine exactly. Thus, the Contracting Authority does not guarantee the use of 100% of the volume specified in Annexes No 1.1 to 1.14 to SWZ. No financial or legal claims are entitled to the Contractors. In relation to the entities indicated in Annex No 1 to SWZ, the Contracting Authority shall ensure that it shall fulfil the order at a level of not less than 60% of the volume set out in Annexes No 1.1 to 1.14 to SWZ,

— as a result of the conclusion of new contracts for the distribution service or in economically justified situations for the Contracting Authority, some of the parameters listed in Annexes No 1.1 to 1.14 to SWZ are subject to change. Such a situation may concern contractual power or tariff (technical reasons), the modification may only be made within the tariff groups in the subject of the contract,

— the estimated electricity consumption of Annexes Nos 1.1 to 1.14 to SWZ has been done with due care, but is indicative,

— for the connection points listed in Annexes 1.1 to 1.14 to SWZ, the role of the Distribution System Operator (hereinafter: the DSO) is performed by Tauron Distribution,

— the role of the electricity retailer for the connection points listed in Annexes No 1.1 to 1.14 to SWZ is fulfilled by the electricity trading company: PGE Skarżysko — Stone for Annex 1m by the Electricity Trading Company: TAURON

The Contractor must have a contract concluded and in force, the so-called General Distribution Agreement, with the local DSO, on the basis of which he may carry out the sale of electricity through the distribution network of that DSO to all the facilities of the Contracting Authority indicated in Annexes No 1.1 to 1.14 to SWZ

A detailed list of what points are handled by which DSO and energy trading company the Contracting Authority shall communicate to the Contractor of this proceeding after signing sales agreements conforming to the model Annexes No 5.1 to 5.14.
