The client intends to procure external legal services in the areas of intellectual property, data protection law, IT law and antitrust law in support of internal legal advice, whereby in the context of the provision of legal services it has to be taken into account that the Fraunhofer-Gesellschaft is one under Art. 91b GG The non-profit research institution subsidized by the Federal Government and the Länder in the legal form of a registered association is subject to public-law framework conditions that can be incorporated into all consulting areas of the Fraunhofer-Gesellschaft. To this end, a framework contract per lot for legal advice and support services is to be completed.

Consulting and support services in the following areas:

- Copyright,

- trademark law,

- competition law,

- patent law (eg advice on employee inventor law, patent searches, patents, preparation of legal opinions or infringement of patents, freedom-to-operate analyzes),

- Press Law.

In addition, the legal support in the licensing / transfer of IP from third parties / to third parties (each also located abroad) is required.

The services acc. § 116 GWB are not the subject of the present procurement.

Advice and support of the company data protection officer of the client, among others at:

- creation of sample texts (contracts, privacy statements, checklists),

- implementation of data protection concepts,

- processing of data protection complaints and requests for information,

- training,

- Preparation of data protection expert opinions.

Advice and support of the client with questions in IT law, in particular:

- support in contract design / drafting of contract models,

- Preparation of expert reports.

Advice and support on antitrust issues, in particular merger control, country-specific filing requirements and transnational issues (DE, EU).
