The subject of the contract are successive deliveries of diesel oil in the amount of approx. 1 550 000 liters to Miejskie Zakład Oczyszczania Sp. z o.o. The Ordering Party reserves the right to make a quantitative change to the subject of the order. The quantity of the assortment should be taken as an estimate. The Contractor is not entitled to any claims for reducing/increasing the quantity of the subject of the contract. The actual amount of fuel delivered will result from the current needs of the Contracting Entity, and the gross remuneration of the Contractor will not exceed the value of the offer.

1. The subject of the contract are successive deliveries of diesel oil in the amount of approx. 1 550 000 liters to Miejskie Zakład Oczyszczania Sp. z o.o. The Ordering Party reserves the right to make a quantitative change to the subject of the order. The quantity of the assortment should be taken as an estimate. The Contractor is not entitled to any claims for reducing/increasing the quantity of the subject of the contract. The actual amount of fuel delivered will result from the current needs of the Contracting Entity, and the gross remuneration of the Contractor will not exceed the value of the offer.

2. The Supplier should guarantee the continuity of supplies and good quality of liquid fuels, in accordance with the currently applicable PN-EN 15293 standards and the Regulation of the Minister of Economy of 9 October 2015 (Journal of Laws, item 1680, as amended) on quality requirements for liquid fuels. In accordance with applicable law, the technical and chemical parameters of the supplied diesel fuel may not be worse than those specified in the annexes to the above-mentioned Regulation. In accordance with applicable law, in the event of discrepancies between the standard and the Regulation, the provisions of the Regulation shall apply.

3. The Contractor is obliged to deliver fuel by tank truck equipped with a pump or distributor and a printer installed in the vehicle in order to confirm the issued liters at real temperature and reference temperature from the pump meter for the Ordering Party, meeting all the requirements of applicable law, in particular the Act of 11 May 2001 – Law on Measures (i.e. Journal of Laws of 2021, item 2068, as amended) and implementing acts to this Act in the field of road tankers (vehicles for the transport of liquid fuels).

4. The vehicle to which the fuel will be supplied shall be equipped with legalized measuring devices measuring the amount of fuel discharge into the storage tank

5. Deliveries will be made to tanks with a Fuelmaster distributor, owned by the Ordering Party, in the following locations:

a) The Seat of the Ordering Party at Saperska 23, 64-100 Leszno – a tank with a capacity of 5,000l,

b) Waste Management Plant in Trzebania, Trzebania 15, 64-113 Osieczna – a tank with a capacity of 5,000l,

c) Municipal Waste Handling Station in Rawicz, Sarnowska Street, 63-900 Rawicz – tank with a capacity of 5,000l,

d) Municipal Waste Handling Station in Gola, 63-800 Gostyń – tank with a capacity of 850l.

6. In addition, deliveries will also be made to mobile tanks owned by the Ordering Party located in the following locations:

a) The Seat of the Ordering Party at Saperska 23, 64-100 Leszno – a tank with a capacity of 450l,

b) Waste Management Plant in Trzebania, Trzebania 15, 64-113 Osieczna – a tank with a capacity of 450l.

7. Diesel oil acceptance will take place on the basis of WZ evidence according to the indications of the Contractor's legalized distribution and measurement devices.

8. The Ordering Party reserves the right to submit a demand from Monday to Thursday from 7:00 to 14:00 to the e-mail address or by phone to the number provided by the Contractor and on Friday from 7:00 to 15:00. It is considered a correct request to send a request to an e-mail address without a return confirmation of receipt of the message.

9. Delivery reported by demand from Monday to Thursday should be made on the next working day by 11:00. Delivery reported by demand on Friday should be carried out on the next Monday or working day by 11:00. The Ordering Party informs that after 13:00 it is not possible to collect fuel in a manner consistent with the observance of health and safety regulations.

10. Each release of diesel fuel from the tank will be confirmed by a printout with the indicated amounts of ON spent in liters at the temperature of the product and the temperature of 15 ° C.
