The right of option – the Ordering Party reserves the right of option in accordance with the disposition of Article 441 paragraph 1 of the PPL Act – applies to all parts of the contract. The waste management method must be carried out in a manner consistent with the hierarchy of waste management methods, in particular in accordance with Annex 1 and 2 of the Act of 14 December 2012 on waste (i.e. Journal of Laws of 2023, item 1597), recovery or disposal processes. The minimum amount of waste planned for management under the basic (guaranteed) order is 400.0 Mg.Form of waste transfer to the Contractor - transport of the Ordering Party, waste in bulk or in bags, dustless or self-unloading vehicles. The waste management method must be carried out in accordance with the hierarchy of waste management methods, in particular in accordance with Annex 1 and 2 of the Act of 14 December 2012 on waste (i.e. Journal of Laws of 2023, item 1597), recovery or disposal processes. The Contracting Authority requires the Contractor to take over non-segregated (mixed) municipal waste directly to municipal installations and/or installations intended for the thermal treatment of municipal waste. The Contractor shall ensure the performance of the contract for non-segregated (mixed) municipal waste using a municipal installation in accordance with Article 38b paragraph 1 point 1 of the Waste Act or an installation for the thermal treatment of municipal waste in accordance with the Act on maintaining cleanliness and order in municipalities and the Act on waste.
