The order includes the renovation of the surface of the provincial road No. 834 Niedrzwica Duża – Stara Wieś, m. Strzyżewice from km 17+640 to km 20+500.
1. The detailed material scope and quantities of works are specified in the attached bill of quantities and Technical Specifications.
2. The Contractor is obliged to ensure safe road and pedestrian traffic conditions in the area of the works covered by the contract on the basis of the Simplified traffic organization project prepared by ZDW in Lublin (for the duration of the works) approved by the Traffic Manager on provincial roads, i.e. the Marshal of the Lubelskie Voivodeship.
3. Renovation of the provincial road surface should be carried out in accordance with the following Technical Specifications:

-D 05.01.04a - Unbound compound roadside surface
-D 05.03.05a - Asphalt concrete surface AC11S - wear layer

-D 06.03.01 - Shearing and replenishment of roadsides
4. The Contractor shall proceed to the execution of works covered by the contract after the protocol transfer of the road lane by the Contracting entity within 7 days of signing the contract.
5. The bill of quantities shall be ancillary. Any lack of certain works necessary to be performed in the bill of quantities or in the tender cost estimate model does not release the contractor from the obligation to perform them within the contractual price.
6. The Contractor shall ensure that the Works covered by the Agreement are managed by persons with qualifications and meeting the requirements set out in the Construction Law, for as long as it is necessary. Failure by the Contractor to provide personnel to manage the works gives the right to the Supervision Inspector or the Contracting Authority to suspend the works in whole or in part. Any interruption in the execution of Works resulting from the lack of personnel to manage the works shall be treated as a break for reasons attributable to the Contractor and may not constitute grounds for changing the time for completion of works.
7. The order (construction works) executed by the Contractor will be covered by the warranty for the period of time resulting from the submitted offer (in accordance with point XIX SWZ).
8. The subject of the contract is described in the manner specified in Article 101(1)(2) and (3) of the Public Procurement Law. The Contracting Authority shall allow solutions equivalent to those described, provided that the Contractor proves in the tender, in particular by means of the evidence referred to in Articles 104-107, that the proposed solutions meet the requirements set out in the description of the subject of the contract to an equivalent degree.
9. As part of the contractual remuneration, the Contractor is obliged to: ensure the participation of electric vehicles or vehicles powered by natural gas in the fleet of vehicles used in the performance of the public task in question, in the share specified in Article 68 paragraph 3 of the Act of 11 January 2018 on electromobility and alternative fuels (Journal of Laws of 2021, item 110, as amended), taking into account Article 36a specifying the rules for rounding percentages when calculating the number of required vehicles, in so far as the performance of a public task requires the disposal of motor vehicles. The specific number of vehicles will be indicated by the Contractor at the stage of signing the contract."
10. A procedure may be annulled following failure to allocate funds to finance a contract. Pursuant to Article 257 of the Public Procurement Law, the contracting authority may cancel the procurement procedure if the public funds that the contracting authority intended to allocate to finance all or part of the contract have not been granted to it, and the possibility of cancelling the procedure on this basis has been provided for in the contract notice.
