1. The subject of the contract is the supply of sausages to the Police School in Katowice for a period of 6 months.

3. The Ordering Party reserves the option of not fulfilling the subject of the contract worth up to 50% of the total gross remuneration. No financial or legal claims are entitled to the Contractor's part of the contract.

4. Delivery, unloading and contributing will be made at the Contractor's expense calculated in the price of the products covered by the contract

2) The quantities provided are estimates and do not oblige the Ordering Party to purchase products in those quantities.

3. The Contracting Authority reserves the possibility of not fulfilling the object of the contract with a value of up to 50% of the total gross rem No financial and legal claims are entitled to the Contractors due to the failure of fulfilment of part of the contract.

4. Delivery, unloading and placing of the object of the contract shall be carried out at the expense of the Contractor as calculated in the price of the products covered by the public contract award contract.

5. Delivery of the object of the order shall be carried out by means of transport of the Contractor authorized for the transport of food

In order to confirm that the deliveries offered conform to certain requirements, the Contracting Authority requires the Contractor to submit, together with the offer, product cards or other documents from which their composition will result and comply with the requirements laid down by the Ordering Party in the assortment Specification- quantitative value as annex No 1A to SWZ.

7. Delivery persons must be entitled to the current medical judgment for sanitary and epidemiological purposes, which they show at the request of the Ordering Party.

8. The Contractor is obliged to have a valid certificate of entry in the register of establishments subject to official control of the competent authorities – in accordance with the Act of 25 August 2006 on food and nutrition safety (i.e. Journal of Laws of 2022, item 2132

As of late as) or the current administrative decision to enter the register of establishments or to approve an establishment issued by the county veterinarian, together with the identification number assigned in accordance with Article 21 (4) of the Act of 16 December 2005 on products of animal origin (i.e. Journal of Laws of 2020, item 1753 of late). The Contractor must be subject to the permanent supervision of the competent authorities.

9. Products offered must comply with the requirements set out in the applicable provisions of the law concerning the production and marketing of food. Each product must be manufactured and marketed in accordance with the requirements of the HACCP system.

10. Details of delivery are set out in the model contract set out in Annex 5 to the SWZ.

11. The Contractor shall ensure the protection of the personal data transmitted, in accordance with the Law of 10 May 2018 on the Protection of Personal Data (Journal of Laws of 2019, item 1781) and Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals in connection with the processing of personal data and on the free movement of such data (hereinafter GDPR) (i.e. OJ EU L 2016 No 119 p. 1). The obligation to inform the Subcontractors, third parties and members of the consortium about the processing of personal data lies with the Contractor. A declaration by the Contractor to fulfil the obligations under Article 13 or Article 14 of the GDPR to the natural persons from whom the personal data directly or indirectly procured to apply for this order will be placed in the tender form of Annex 1 to the SWZ.
