Completion date of the contract: 12 months from the date of conclusion of the contract and obtaining all necessary administrative decisions required for the proper performance of the contract, (the entry will be entered into the contract if obtaining a decision proves necessary) or until the quantity covered by the contract is exhausted, or for a shorter period than a calendar year, if it results from the terms of the administrative decision authorizing the transboundary shipment of waste. The Ordering Party reserves the right to extend the Contract for another 3 months if the Contractor fails to deliver 600 tonnes during the 12-month contract period as long as it does not violate the terms of the permit for the transboundary shipment of waste, if the permit is required. Depending on the type and nature of zinc oxide, the Contractor is obliged to provide the transport service of the subject of the contract in accordance with the international convention on the carriage of dangerous goods and dangerous goods by road - ADR. In addition, if zinc oxide will also have the status of waste also in accordance with the Waste Act of December 14, 2012 (Journal of Laws 2018, item 995 of 24.5.2018, as amended) and the Act of 10.2.2017 Environmental Protection Law (Journal of Laws 2018, item 799 of 27.4.2018, as amended), as well as in accordance with other provisions in this respect, in particular in accordance with the Regulation of the Minister of the Environment of 7 October 2016 on the detailed requirements for the transport of waste (Journal of Laws 2016 item 1742). If the Contractor imports zinc oxide from abroad with the status of a non-waste chemical, he is obliged to comply with the requirements set out in Regulation EC No. 1013/2006 of the European Parliament and of the Council of June 14, 2006 on waste shipments (Official Journal EU L 190 of 12.7.2006, p. 1, as amended) and the Act of 29.6.2007 on international shipments of waste (Journal of Laws 2018, item 296 of 1.2.2018) and the implementing provisions for . Act. In the case of the supply of zinc oxide having the status of a product, the Contractor will meet all current legal requirements for the marketing of chemical substances on their own, as components of preparations or in products. The Employer ensures that the use of the offered zinc oxide as a raw material in the production of zinc salts is envisaged, or undertakes to take into account such use within 1 month of signing the contract. The Contractor will make each delivery within max. 7 days from the date of sending the order or telephone demand notification. Deliveries are allowed under a pre-agreed and bilaterally agreed schedule. Unloading the subject of the contract is the responsibility of the Employer. The Contractor shall deliver the safety data sheet with attachments prepared in accordance with the provisions of the REACH Regulation, if required, at the latest with the first delivery. The Contractor shall provide a certificate specifying the chemical composition of the material, including in particular the percentage composition of the elements referred to in the ToR for each batch of delivered material.
