In accordance with article 38, § 1, 1º, a) and c), of the law of 17.6.2016, the contract was awarded by competitive procedure with negotiation.

The chosen procurement method is motivated by the following considerations:

- the needs of the contracting authority cannot be met without adapting immediately available solutions: this is a technically complex contract, for which previous award procedures have not succeeded, among others for reasons related to the technical content of the tenders submitted, which sufficiently demonstrates the absence of immediately available solutions;

- the contract cannot be awarded without prior negotiation due to special circumstances related to its nature, complexity or legal and financial arrangement or due to the risks attached to it: during previous procurement procedures, only irregular or technically unacceptable offers were introduced. This circumstance characterizes the complexity of the contract to be awarded: it is a complex contract from a technical point of view, for which the contracting authority must be able to have the possibility of entering into negotiations with the economic operators in order to develop a solution corresponds precisely to his need.

After the presentation of the offers, the adjudicator will conduct negotiations.

The adjudicator reserves the right to attempt to regularize an offer affected by one or more substantial irregularities. This provision is adopted in application of article 76 § 4 of the royal decree of 18.4.2017.
