The subject matter of the present award procedure is a framework agreement with an economic operator pursuant to Section 21 (3) of the VgV for the rental of software for the hospitals of Sana Kliniken AG as contracting authorities entitled to call up (Annex 3 to the contract).
Version 11 or 12 of the Igel OS operating system (specified by the authorized institution) is required as a subscription license as well as a permanent, granted right of use from the end of the term including manual, maintenance and support for a period of 36 months.
SLAs, response times, service times, resolution times and other service management KPIs result from the IGEL Maintenance and Support Terms EMEA valid at the time the contract is concluded.
Licences are called up by those authorised to call (see Appendix 3) and can be carried out in different quantities at different times. It is not possible to specify a specific retrieval behaviour on the part of the individual persons authorised to retrieve the data.
The framework agreement is a contract concluded for the term specified in the notice which obliges the contractor(s) to perform the services called up with individual contracts under the conditions laid down in the framework agreement and the respective individual contract.
These individual contracts shall be awarded exclusively by the contracting entities referred to in Appendix 3 "List of contracting entities" to the undertaking(s) which is(or are) party to the framework agreement at that time.
The clients entitled to call are recipients of subsidies from the Hospital Future Act and are obliged to comply with public procurement law by the subsidy notice. Some contracting authorities are bound by (antitrust) public procurement law as contracting authorities within the meaning of the GWB.
