1. The subject of the contract is the supply of electricity for the buildings of the City Hall of Kraśnik, and other utility facilities, municipal facilities of the city of Kraśnik, as well as for street lighting in the city of Kraśnik.
2. The scope of the contract includes the supply of electricity to:
1) 13 energy collection points supplying administrative buildings, a market square, public chalets and fountains, for which the city of Kraśnik is the payer of invoices for electricity (detailed list is included in Annex 1 to the ToR, Table 1);
2) 102 street lighting supply points - for which the invoice payer for electricity is the city of Kraśnik (a detailed list is included in Annex 1 to the ToR, Table 2);
3) 32 energy collection points constituting the supply of buildings, premises and utility objects - for which the invoices for electricity are paid by organizational units and legal entities of the city of Kraśnik (a detailed list is contained in Annex No. 1 to the ToR).
1. The subject of the contract is the supply of electricity for the buildings of the City Hall of Kraśnik, and other utility facilities, municipal facilities of the city of Kraśnik, as well as for street lighting in the city of Kraśnik.
2. The scope of the contract includes the supply of electricity to:
1) 13 energy collection points supplying administrative buildings, a market square, public chalets and fountains, for which the city of Kraśnik is the payer of invoices for electricity (detailed list is included in Annex 1 to the ToR, Table 1);
2) 102 street lighting supply points - for which the invoice payer for electricity is the city of Kraśnik (a detailed list is included in Annex 1 to the ToR, Table 2);
3) 32 energy collection points constituting the supply of buildings, premises and utility objects - for which the invoices for electricity are paid by organizational units and legal entities of the city of Kraśnik (a detailed list is included in Annex 1 to the ToR, Table 3).
3. Electricity should meet technical standards in accordance with the provisions of the Energy Law and executive ordinances to this Act and applicable standards.
4. The estimated total amount of energy supplied in the 24-month delivery period will be 8 206 MWh. By tariff group and time zone, the estimated amount of energy supplied (per year) is:

Where:
1) zone I, according to the tariff group, means for two-zone measurements respectively: peak, day,
2) zone II, according to the tariff group, means for two-zone measurements respectively: off peak, night,
3) zone III, according to the tariff group, means for one-zone measurements: round the clock, respectively.
5. The energy consumption determined by the Purchaser with due diligence is only indicative and does not constitute an obligation to purchase energy in the given quantity. The total amount of energy consumption may decrease depending on the current needs of the Employer (max. By 20%). The Contractor shall not be entitled to any claim for failure to collect the estimated amount of energy by the Employer.
6. On the basis of art. 34 section 5 of the Public Procurement Law, the Awarding Entity provides for the option right to 20% of the basic contract to be used:
1) the purchase of the subject of the contract under the option right may not exceed 20% of the value of the contract concluded,
2) exercising the option right is not mandatory. If the Employer does not exercise the option option, the Contractor shall not be entitled to any claims in this respect,
3) unit energy prices specified in the contract will also apply in the case of a delivery carried out under an option right,
4) the option right will be exercised through written orders addressed by the Employer to the Contractor. Orders will specify the quantity and tariffs of energy supply. Performance of the contract and application of the option right is only possible during the term of the concluded contract.
7. The contractor will be obliged to perform the procedure of changing the seller. The Purchaser will grant the powers of attorney necessary to submit the contract for the sale of electricity to the Distribution System Operator. Before signing the contract, the contracting authority will provide the Contractor, whose offer is selected as the most advantageous, with the data necessary to perform the procedure of changing the seller.
8. Currently, the Employer has separate contracts for the sale and distribution of electricity. Agreements for the provision of distribution services have been concluded for an indefinite period. The current electricity seller is Tauron Sprzedaż Sp. z o. o., Łagiewnicka 60, 30-417 Kraków, POLAND. The Operator of the Distribution System is PGE Dystrybucja SA, ul. Garbarska 21A, 20-340 Lublin, POLAND. The current seller for items 2.5 and 2.6 in table 3 of Annex 1 to the ToR is PGE Obrót SA.
