►A contractor who invokes the use of equivalent solutions is obliged to prove that the solution offered by him meets the requirements specified by the Contracting Authority in the description of the subject of the contract (Article 101(5) of the Public Procurement Law).

In connection with the reference to Polish standards in the description of the subject of the contract, the Ordering Party allows equivalent products with physicochemical characteristics with a higher or lower percentage of their content in the product by a maximum value of +/- 1%, provided that they ensure better quality of the product and the safety of its consumption. If the Contractor refers to equivalent solutions, he is obliged to attach with the offer:

a list of products with equivalent solutions applied;

description of equivalent solutions, e.g. detailed product sheet, declaration of conformity, laboratory test report, confirming the compliance of physico-chemical and quality properties of a given product in relation to those described by the Ordering Party.

A contractor who does not offer equivalence is not obliged to submit descriptions and materials as above.

Failure by the Contractor to submit the documents indicated above, i.e. confirming that the offered subject of the contract meets the requirements specified by the Contracting entity or information that the offer contains equivalent solutions - will be tantamount to offering the subject of the contract specified by the Contracting entity.

►The Contracting Authority requires the Contractors submitting the bid to submit a bid bond before the deadline for submitting tenders in the total amount of PLN 5,000.00. The Contractor is obliged to lodge a bid bond for the entire period of validity of the offer.
