The subject of the contract is the sale by the Contractor of electricity for the needs of ZWiK Ciechanów with a total estimated volume of 4,200 MWh, including: Tariff Group B23: morning peak - 700 MWh, afternoon peak - 400 MWh, other hours of the day - 2500 MWh; Tariff group C12A: peak zone - 180 MWh, off-peak zone - 420 MWh, and purchase of electricity generated in RES biogas power plant of the Ordering Party with a capacity of 0.5 MW, with an estimated volume of 150 MWh together with a commercial balancing service. The detailed scope of the contract, i.e. the list of facilities in the ZWiK in Ciechanów, the annual estimated consumption and the planned sale of electricity is specified in Appendix No. 1 to the SWZ.

The sale of electricity for own and generated energy will take place under the conditions set out in the provisions of the Act of 10 April 1997 – Energy Law (i.e. Journal of Laws of 2021, item 716, as amended) and in accordance with the implementing regulations issued to this Act, in particular with the quality standards of customer service specified in the Regulation of the Minister of Economy of 6 March 2019 on detailed rules for the formation and calculation of tariffs and settlements in trade. electricity (Journal of Laws of 2019, item 503, as amended). The detailed scope of the contract, i.e. the list of facilities in the ZWiK in Ciechanów, the annual estimated consumption and the planned sale of electricity is specified in Appendix No. 1 to the SWZ. Distribution services will be provided on the basis of separate agreements concluded by the Ordering Party for an indefinite period for a given PPE with the Distribution System Operator (DSO), i.e. Energa – Operator S.A. with its registered office in Gdańsk, subject to point below. The Ordering Party reserves the right to reduce or increase the total amount of energy purchased, in relation to the amount specified in paragraph 1 of this paragraph, caused by the respectively reduced or increased electricity consumption in individual PPEs, specified in Appendix No. 1 to the Agreement or a change in the number of PPE. Any increase in the total amount of electricity purchased will not exceed 30%, and the contract will be awarded in the manner provided for in Article 214(1)(7) of the PPL Act under the conditions specified in the contract. The basis for the settlements will be information on the amount of electricity consumed provided to the Contractor by the DSO. The Contractor, in the name and on behalf of the Ordering Party, pursuant to the type power of attorney granted and the data provided to him after accepting the offer, will carry out the procedure of changing the seller and establishing an entity responsible for balancing the POB. The Ordering Party shall grant the Contractor selected in the proceedings a power of attorney to submit a sales contract on behalf of the Ordering Party to the Distribution System Operator in order to implement the concluded electricity sales contract and represent the Ordering Party in the process of changing the seller. The Contractor undertakes to balance the Contracting Authority's commercial balance and to act as the entity responsible for commercial balancing of the URDw and to report this fact to the relevant Distribution System Operator.

The Contractor shall have an appropriate contract for the provision of electricity distribution services concluded with the Distribution System Operator, to whose network the Ordering Party's PPE specified in Annex 1 to the SWZ is connected, enabling the sale of electricity to the Ordering Party for its own needs and the purchase of electricity generated in the Ordering Party's RES installation. The Ordering Party informs that in accordance with point A.3.5 of the Instructions for Operation and Operation of the Distribution Network of ENERGA-OPERATOR S.A.: "POB is indicated by the seller and the company involved in the production of electricity, in the contract for the provision of distribution services. Settlements resulting from the imbalance of electricity supplied and taken from the system, for a given power consumption point (PPE), shall be made by only one POB." Annex 1 to the SWZ informatively indicates the parameters for the PPE point, which may differ from those currently in force or may be subject to change during the term of the contract for the sale of electricity within the tariff groups included in the SWZ. The contracting authority will prefer offers in which the prices of energy sold will be different for time zones in appropriate tariffs.
