The subject of the contract consists of m.in: collection, transport and management of selectively collected municipal waste coming directly from the areas of real estate inhabited and uninhabited within the administrative boundaries of the Jejkowice Municipality;
1. The subject of the contract shall consist in particular of a material scope covering m.in:
a) collection, transport and management of separately collected municipal waste coming directly from the areas of real estate inhabited and not inhabited within the administrative boundaries of the municipality of Jejkowice;
b) collection, transport and management of unsegregated (mixed) municipal waste coming directly from the areas of real estate inhabited and uninhabited within the administrative boundaries of the jejkowice commune;
c) collection, transport and management of selectively collected municipal waste from municipal points / places of selective collection of municipal waste located m.in. ZSP Jejkowice, UG Jejkowice, Apteka Jejkowice, Ośrodek Zdrowia;
d) providing the owners of real estate in the Jejkowice Commune with bags for selective collection of municipal waste and containers for collecting ash. The exception is real estate that has declared composting BIO waste – BIO waste bags are not delivered to these properties;
e) developing schedules for collecting waste from the property and transferring them to property owners, after approval by the Ordering Party;
f) others listed in the Detailed Subject of the Order constituting an attachment to this SWZ
2. The Contractor is obliged to perform the subject of the contract in accordance with the provisions of the Act of 13 September 1996 on maintaining cleanliness and order from municipalities (i.e. Journal of Laws of 2022, item 1297, as amended) and the provisions of the Regulations for maintaining cleanliness and order in the Municipality of Jejkowice and other acts in force during the term of the contract.
4. The subject of the contract has not been divided into lots. The Contracting Authority does not allow the possibility of submitting partial tenders.
Reason: Dividing the contract into lots could jeopardise the proper performance of the subject of the contract and worsen the standard of service provided.
5. The Contracting Authority does not allow the possibility of submitting a variant offer referred to in Article 92 of the Public Procurement Law.
6. The Ordering Party does not allow the submission of offers in the form of electronic catalogs or attaching electronic catalogs to the offer.
7. The contracting authority provides for the award of contracts referred to in Article 214(1)(7) of the Public Procurement Law with a value of not more than 50% of the basic contract.
The contracts will consist in the repetition of similar services as the basic contract and will be consistent with the subject of the basic contract, i.e. covered by this proceeding. The condition for awarding contracts will be to conduct negotiations with the selected contractor.
8. Pursuant to Art. 95(1) of the Public Procurement Law. The Contracting Authority requires the Contractor, subcontractor or further subcontractor to employ persons performing the following activities in the scope of the contract performance, on the basis of an employment relationship within the meaning of the Act of 26 June 1974 - Labour Code (i.e. Journal of Laws of 2022, item 1510):
a) Driving vehicles collecting municipal waste
b) Operation of loading equipment of municipal waste collection vehicles (municipal waste loaders)
9. Detailed requirements for the implementation and enforcement of the employment requirement on the basis of an employment contract are specified in the model contract, constituting annexes No. 3 to the SWZ respectively.
