4. Quality standards
1) The subject of the order is the supply of electricity with certain quality standards in accordance with applicable regulations.
2) Electricity quality standards are described in the Pe Act and in the Regulation of the Minister of Economy of 4 May 2007 on the detailed conditions for the operation of the power system (Journal of Laws of 2007 No. 93, item 623, as amended). The rules for shaping and calculating tariffs and settlements in electricity trading are set out in the Regulation of the Minister of Climate and Environment of 29 November 2022 (Journal of Laws of 2022, item 2505, as amended).

6. The measuring system shall be adapted to the procedure of changing the seller. Billing period – 1 month.
7. The current sales contract is concluded for a definite period of time and does not require notice.

9. Division of the contract into lots:
The contracting authority divided the contract into two parts:
• Part 1 of the contract – Supply of energy to premises and facilities in the period from 01.07.2023 to 31.12.2023. – a detailed PPE List is attached as Annex 1a to the SWZ
• Part 2 of the order – For premises and facilities in the period from 01.01.2024 to 31.12.2024. – a detailed list of PPE is attached as Annex 1b to the SWZ.
Economic operators may submit tenders for one or two lots.
10. The Ordering Party meets the criterion of the Eligible Recipient.
11. The Contractor, based on the Power of Attorney granted, will be obliged to submit the contract on its own behalf and the contracting authority to the relevant DSO in accordance with applicable regulations and to represent it before the DSO in the process of changing the seller.
12. The Ordering Party as a reserve seller indicates - Enea S.A.
13. The condition for starting electricity supplies within the indicated period is a positive completion of the procedure of changing the seller, possession by the customer of a valid contract for the provision of electricity distribution services and effective expiry of the existing contract for the sale of electricity.

15. In Annex 1a/1b to the SWZ, in the column "Buyer / Recipient (address for sending invoices)" the address for sending the invoice is indicated. Data on issuing and delivering invoices will be included in the Electricity Supply Agreement / Annex to the Agreement.
16. The contracting authority has the status of a customer, therefore it has the right to purchase energy from the seller of its choice (Article 4j (1) of the EP Act).
17. The Contracting Authority does not provide for an electronic auction.
18. The contracting authority does not provide for the award of contracts referred to in Article 214(1)(8) of the PPL.
