Description:
Maintenance, repairs, replacement of elements and modifications of traffic lights in the city of Bytom in the period of 24 months

1. The subject of the contract is maintenance, repairs, replacement of elements and modifications of traffic lights in the city of Bytom within 24 months from the date of conclusion of the contract, but not earlier than from 01.01.2024.

2. The subject of the contract and the manner of its implementation shall be determined by:

a) Detailed Description of the Subject of the Order (hereinafter referred to as SOPZ),

(b) List of signalling and radar boards (basic scope),

(c) Signalling list (optional scope),

d) Draft contractual provisions, constituting relevant Annexes to the SWZ.

1. The subject of the contract is maintenance, repairs, replacement of elements and modifications of traffic lights in the city of Bytom within 24 months from the date of conclusion of the contract, but not earlier than from 01.01.2024.

2. The subject of the contract and the manner of its implementation shall be determined by:

a) Detailed Description of the Subject of the Order (hereinafter referred to as SOPZ),

(b) List of signalling and radar boards (basic scope),

(c) Signalling list (optional scope),

d) Draft contractual provisions,

constituting the relevant Annexes to the SWZ.

3. The Contractor is obliged to remove the signalling failure (i.e. take corrective actions on the site) within no more than 120 minutes from the notification by the Contracting Authority or the Police. In connection with the above, the Contractor will be obliged to provide round-the-clock telephone duty (also on Sundays, holidays and non-working days)

in order to contact the Ordering Party. In situations of destruction of municipal property (need to replace signalling elements), the Contractor shall proceed to repair the facility after prior agreement with the Ordering Party.

The time of proceeding to remove the signaling failure will be one of the criteria for the evaluation of the offers referred to in Chapter XVIII of the SWZ.

4. Removal of traffic light failures, replacement of worn elements and modifications will take place on the basis of protocols of transfer of works (except for lump sum works specified in SOPZ).

5. When carrying out work, the Contractor is obliged to comply with the rules and conditions for placing road safety signs and devices specified

in Annexes Nos 1, 3, and 4 to the Regulation of the Minister of Infrastructure of 3 July 2003

on detailed technical conditions for road signs and signals and road safety devices and conditions for their placement on roads (Journal of Laws of 2019, item 2311).

6. The Contractor is obliged to neutralize and/or manage materials from demolition (waste) and to settle the above activities with the Ordering Party by submitting a statement on the disposal and/or management of these materials before the end of the contract.

7. The Contractor is obliged to have an entry in the BDO register or a signed contract with an entity that is entered in BDO and is obliged to neutralize and/or manage materials from demolition (waste). At the same time, the Contractor, in accordance with Article 3(1)(19) and (32) of the Waste Act of 14 December 2012 (consolidated text: Journal of Laws of 2023, item 1587, as amended), is the producer and holder of the above-mentioned waste and undertakes to neutralize and/or manage it in accordance with applicable law in a manner that respects the natural environment.
