The subject of the order is the delivery of electricity within the meaning of the Act of 10.4.1997 Energy Law (OJ 2017, item 220, as amended) hereinafter referred to as supply of active electricity, in the forecasted total quantity, for the duration of the contract, approx. 22 GWh for 1607 Energy Consumption Points for the following Parties to the Agreement (Members of the Purchasing Group):
a) City of Węgrów - Leader of the Purchasing Group,
b) Gmina of Ożarów Mazowiecki,
c) Łochów commune,
d) Municipality of Liw,
e) Commune Zaręby Kościelne,
f) Mszczonów commune,
g) Gmina Baranów,
h) Sokołów Podlaski commune,
i) Wiskitki Commune,
j) Kampinos commune,
k) Nowa Sucha commune
1. The subject of the order is the delivery of electricity within the meaning of the Energy Law Act of April 10, 1997 (Journal of Laws 2017, item 220, as amended), hereinafter referred to as supply of active electricity, in the forecasted total quantity, for the duration of the contract, about 22 GWh for 1607 Energy Consumption Points for the following Parties to the Agreement (Members of the Purchasing Group):
a) City of Węgrów - Leader of the Purchasing Group
b) Gmina of Ożarów Mazowiecki
c) Łochów commune,
d) Municipality of Liw,
e) Commune Zaręby Kościelne,
f) Mszczonów commune,
g) Gmina Baranów,
h) Sokołów Podlaski commune,
i) Wiskitki Commune
j) Kampinos commune
k) Nowa Sucha commune
The detailed scope is set out in Annex 1 to the ToR.
1.1 The contractor at the latest on the day the contract is started on the day of signing the contract with individual Procurers who are members of the purchasing group should have concluded agreements or promise of the agreement for the provision of electricity distribution services with distribution system operators: PGE Dystrybucja SA, (Wodzi Branch, Białystok and Łódź ), RWE Stoen Operator Sp. z oo, PKP Energetyka Spółka Akcyjna, ESV6 Sp. z o. o. (formerly Energetyka Wisłosan, Ożarów Mazowiecki) and Energa Operator SA Contractor's statement that he has a valid contract or promise of a contract with the appropriate Distribution System Operator (hereinafter: "DSO") enabling the sale of electricity through the DSO distribution network to the Purchaser's facilities will be a condition for signing a public procurement contract.
1.2 The Ordering Party reserves the right to reduce the number of energy consumption points indicated in Annex 1 to the ToR in the case of changes in the ownership of administrative rights, change of use or closure of individual energy consumption points.
1.3. Ordering party in accordance with the provisions of art. 34 par. 5 of the Act provides for the option of applying the option right. In the event that during the implementation of the contract it turned out that there will be new electricity consumption points not indicated in this ToR, the Contracting Authority reserves the right to exercise the option and order electricity to these new points at prices the Contractor has specified in its offer. The supply of electricity under the law option may not exceed 25% of the basic scope of the subject of the contract.
1.4. Sale of electricity should be in accordance with the provisions of the Energy Law and executive regulations to this Act.
