The subject of the contract is the provision of cleaning and maintenance services for outdoor areas in the units of the University of Silesia in Katowice and Sosnowiec. A detailed scope of activities, a list of facilities with location and area for individual tasks is included in Appendix 2 to the Terms of Reference.
Part A: Cleaning and maintenance of outdoor areas at the University of Silesia facilities located in the city of Katowice1) The subject of the contract is the provision of cleaning and maintenance services for outdoor areas in the units of the University of Silesia in Katowice, from the date of conclusion of the contract (but not earlier than from 01.01.2024) to 31.12.2026 or until the funds allocated by the Contracting Authority for the performance of the contract in a given part (contract value) are exhausted, depending on which of the events occurs first. A detailed scope of activities, a list of facilities with location and area for individual tasks is included in Appendix 2 to the Terms of Reference.
2) The Contractor should carry out the subject matter of the contract using its own materials and necessary means (auxiliary materials for the performance of the above-mentioned works, i.e. garbage bags, bin bags, leaf bags, sand, lime, chlorinated rubber paint, herbicides are provided by the Contractor).
3) The maximum response time of the Contractor to each call of the Contracting Authority resulting from sudden, important events, e.g. in the event of heavy snowfall, heavy littering of the area after a mass event, etc., is 4 hours and will be counted from the moment of telephone notification by the Contracting Authority and means the time in which the Contractor will start performing the service. The contractor may shorten the response time in relation to the required time indicated above. An offer that provides for a shortened response time will receive points in the evaluation of offers using the criterion of selecting the most advantageous offer.
4) Responsibility before the controlling institutions (municipal police, sanitary inspectorate) in the scope of covering any fines rests solely with the Contractor.
5) The Contractor shall be liable for any damage caused on the premises of the University of Silesia by employees employed by the Contractor and performing the tasks of the contract.
6) The Contractor is obliged to have civil liability insurance for the performance of business activity related to the subject of the contract for the sum insured not less than PLN 150,000.00 for one and all events throughout the term of the contract, starting from the first day of providing the service. If the contract with one Contractor is concluded for 2 parts of the contract, it will be sufficient to prove that the company has civil liability insurance for the sum insured not less than required for one lot, i.e. PLN 150,000.00 for one and all events.
7) The Contracting Authority requires that activities related to (1) cleaning and maintenance of cleanliness on lawns, pavements, parking lots, internal roads, access roads, stairs, entrances to buildings, container boxes; (2) cleaning and maintaining cleanliness by, for example, collecting papers, cans, bottles and other debris; (3) during the winter, performing works to ensure safe communication on the premises of the facilities, the scope of which depends on weather conditions: snow removal (in the case of snowfall), sprinkling sand on icy pavements and access to buildings with stairs, removing slush from pavements (in the thaw); (4) in the autumn, raking leaves (does not apply to the personal performance of activities by the Contractor or subcontractor) was performed by persons employed by the Contractor (or subcontractor, if the Contractor entrusts the performance of part of the order to a subcontractor) on the basis of an employment relationship within the meaning of the Act of 26 June 1974 – the Labour Code (i.e. Journal of Laws of 2023, item 1465);
8) The contracting authority does not provide for the obligation to personally perform key tasks related to service contracts by individual Contractors jointly applying for the award of a contract within the meaning of Article 60 of the PPL, or related to the participation of entities providing resources within the meaning of Article 121 of the PPL.
9) The contractor may entrust the performance of part of the contract to subcontractors.
