The subject of the contract are "Successive deliveries of concentrates for extracorporeal dialysis to the Hospital Pharmacy of the Provincial Hospital Complex in Kielce". Subjective evidence to be submitted by the contractor whose bid has been rated the highest before awarding the contract in order to confirm the absence of grounds for exclusion and to confirm compliance with the conditions for participation in the proceedings: 1) information from the National Criminal Register prepared not earlier than 6 months before its submission, to the extent specified in:  Article 108(1)(1) and (2) of the Act  Article 108(1)(4) of the Act on Public Procurement concerning the decision prohibiting applying for a public contract as a criminal measure. (The contractor/third party submits relevant information to the ESPD in parts III/A and III/D), 2) a list of supplies made by the contractor in the last three years before the deadline for submission of tenders (and if the period of conducting business activity is shorter – in this period) together with the value, subject, dates of execution and the entity to which the deliveries were made and attachment of evidence specifying, whether these deliveries have been made properly. In the above-mentioned list, the Contractor indicates only supplies in order to confirm compliance with the conditions for participation in the procedure. The Contractor should attach to the list proof that the deliveries were made properly, i.e. references or other documents drawn up by the entity for which the supplies were made. If the Contractor is unable to obtain this document for reasons beyond its control – the Contractor's statement (the Contractor submits relevant information in the ESPD in part IV/C(1b)), 3) the Contractor's statement on the lack of belonging to the same capital group within the meaning of the Act of 16 February 2007 on competition and consumer protection (Journal of Laws of 2020, items 1076 and 1086), with another contractor who has submitted a separate bid, partial bid or statement on belonging to the same capital group together with documents or information confirming the preparation of the offer, partial bid independently of another contractor belonging to the same capital group - Art. 108(1)(5) of the Public Procurement Act, 4) the contractor's statement on the validity of the information contained in the statement referred to in Art. 125(1) of the Public Procurement Act with respect to the grounds for exclusion from the proceedings specified in the SWZ (the model statement is attached as Annex 7 to the SWZ), referred to: • in Article 108(1)(3) and (6) of the Public Security Act, • Article 109(1)(5) and (7)-(8) of the Act • Article 7(1) of the Act on Special Arrangements for Counteracting Support for Aggression against Ukraine and Serving the Protection of National Security (Journal of Laws of 2022, item 835) • Article 5k of Regulation 2022/576 of 8 April 2022 amending the Regulation ( EU) No 833/2014 concerning restrictive measures in connection with Russia's actions destabilising the situation in Ukraine (Official Journal of the European Union No L 111, 8.4.2022, p. 1), 5) if the contractor relies on the technical or professional abilities or the financial or economic situation of entities providing resources on the terms set out in Article 118 of the Public Procurement Act.
