The subject of the contract is the purchase of coordination services and inspections of projects co-financed under the Smart Growth Operational Programme 2014-2020 (POIR) supervised by the National Centre for Research and Development in 2023.
The subject of the contract includes, m.in the following activities of the Contractor: preparation and performance of 60 inspections in 2023 at beneficiaries implementing projects co-financed under Measures 1.1, 1.2, 4.1 of the Smart Growth Operational Programme, by 22 December 2023. Inspections will be carried out at the place of implementation of the project or at the beneficiary's premises (including any place directly related to the implementation of the project) in the location throughout the country.
The Contracting Authority provides for the option to exercise the right.
Checks during the implementation of the project are carried out in the following manner:
1. planned audits – audits included in the Annual Audit Plan of the Operational Programme for a given financial year,
2. ad hoc audits – inspections carried out in the event of suspicion of irregularities committed by the beneficiary or significant deficiencies in the implementation of the project, including suspicion of double financing of expenditure in the project. Ad hoc checks may be carried out without informing the beneficiary of the intention to carry out checks, and their scope is determined on a case-by-case basis for the project.
The subject of the contract includes audits of projects under the following activities/sub-measures of the OP IR implemented by NCBR:
(a) 1.1.1 "Industrial research and development by enterprises"
(b) 1.1.2 "R+D work related to the development of a pilot/demonstration plant"
(c) 1.2. "Sectoral R+D programmes"
(d) 4.1 "Research and development"
The subject of the contract shall include, among other things, the following activities of the
1. preparation and performance of 60 inspections in 2023 at beneficiaries implementing projects co-financed under Measures 1.1, 1.2, 4.1 of the Smart Growth Operational Programme, by 22 December 2023. Inspections will be carried out at the place of implementation of the project or at the beneficiary's premises (including any place directly related to the implementation of the project) in the location throughout the country.
2. if, as a result of COVID-19 or other emergency situation, it is impossible or significantly difficult to carry out inspections at the project implementation site or at the beneficiary's premises, the inspections will be carried out by the Contractor using electronic means of communication (control on documents "from behind the desk");
3. preparation of complete documentation related to each audit carried out (including information providing a full audit trail), including checklists and post-audit information;
4. Preparation of the final report on the implementation of the subject of the contract.
The term of the contract:
1. The Contractor is obliged to complete the subject of the contract by 31 May 2024, provided that the final report will be submitted by 30 April 2024.
2. The last inspection of the Project at the place of implementation/from behind the desk (on documents) should be completed no later than 22 December 2023.
The Contracting Authority reserves the right of option, once or repeatedly, by ordering the Contractor to carry out additional inspections of projects in a maximum of 40 (forty) inspections. The contracting authority will be able to exercise the option right until 22 December 2023 (detailed information in this respect can be found in the Draft Provisions of the Agreement).
The exercise of the option right shall take place through a written declaration of will of the Ordering Party on the exercise of the option right. Both the scope and the date of the project inspection will be determined in consultation with the Contractor.
