Description:
Receipt, transport and disposal of medical waste for the purposes of the John God Self-Public Provincial Hospital in Lublin

1. The object of the order is the service of the collection, transport and disposal of medical waste from the John God Self-Public Provincial Hospital in Lublin.

2. A detailed description of the object of the contract and the requirements in relation to the subject of the contract is contained in Annex 1 to the SWZ.

3. This description should be read together with any changes to the content of the specifications, which are, for example, the result of the answers to Contractors' queries.

5. The quantity of the assortment in the Annex is indicative and therefore the Contractor will not be entitled to claim the fulfilment of the quantity required if the needs of the Contracting Authority are less than 70% of the contract.

6. The Parties shall allow for quantitative return of individual assortment items subject to the contract provided that the value of the service provided cannot exceed the overall value of the contract.

1.1. The subject of the order is a service for the collection, transport and disposal of medical waste from the John God Public Provincial Hospital in Lublin.

1.2. The Contracting Authority informs that it produces medical waste with codes:

(a) 18 01 01 - surgical and surgical instruments and their residues (excl. 18 01 03) meaning so-called “sharps” — objects which, because of their surface, can cause at their touch, even without severe pressure, a cut or stab wound, are e.g. infusion systems, lancets, surgical knives, scalpels, scissors, scrapers, chisels, files,

(b) 18 01 02 - body parts and organs and containers for blood and preservatives for their storage,

(c) 18 01 03 - other waste which contains live pathogenic microorganisms or toxins thereof and other forms capable of transferring genetic material or suspected to cause diseases in humans and animals including highly infectious waste,

(d) 18 01 06 - chemicals, including chemical reagents, containing hazardous substances,

(e) 18 01 08 - cytostatic and cytotoxic drugs,

(f) 18 01 09 - medicines other than those listed in 18 01 08,

g) 18 01 82 - residues from the nutrition of patients of infectious departments.

— in accordance with the Regulation of the Minister of Climate and Environment of 2 January 2020 on the Waste Catalogue (Journal of Laws 2020, item 10).

Proceedings concerning the implementation of this medical waste collection, transport and disposal service shall be carried out taking into account:

a. Methods of disposal of waste: in accordance with Article 95 (2) of the Waste Act, infectious medical waste shall be disposed of by thermal conversion in hazardous waste incinerators. They are forbidden to be disposed of in co-incinerators.

b. Receipt of waste: every time drawn up document, waste transfer card” in accordance with the Regulation of the Minister of the Environment of 25 April 2019 on model documents used for waste records (OJ 2019 item 819)

c. Waste weight shall be recorded each time in,, Waste Transmission Charter” — generated in the BDO system.

d. Waste Disposal Confirmations: based on Article 95 (2) of the Waste Act — the Contracting Authority requires confirmation of the BDO to be generated from the database (BDO) for each month.

The Contracting Authority shall require that waste received by the Contractor be transported/delivered to the disposal facility without repackaging or additional packaging. The provision of the service shall be carried out in accordance with applicable law in the territory of the Republic of Poland, i.e.:

1) The Laws of 14 December 2012 on Waste (Journal of Laws of 2021, item 779 as amended),

2) Regulation of the Minister of the Environment of 25 April 2019 on model documents used for waste records,

3) Regulation of the Minister of Climate of 2 January 2020 on the catalogue of waste (OJ 2020, item 10),

4) Regulation of the Minister of Health of 5 October 2017 on the detailed method of handling medical waste (Journal of Laws 2017, item 1975),

5) The Law of 27 April 2001 of Environmental Law (Journal of Laws of 2020, item 1219 as amended),

6) Laws of 19 August 2011 on the Carriage of Dangerous Goods (Journal of Laws of 2021, item 756 as amended),

7) Laws of 6 September 2001 on road transport (Journal of Laws of 2019, item 2140 as amended).

The conditions for the execution of the contract shall be defined by the contractual provisions constituting Annex 8 to the SWZ.
