The waste stream in individual fractions the contractor is obliged to estimate taking into account:
- the estimates indicated in Annex 8 to this SWZ,
- forecast of the municipal waste stream for rural areas included in the current Waste Management Plan for the Łódź Voivodeship.
It is anticipated that the volume of waste during the duration of the contract may change.
Frequency of waste collection. The Contractor shall collect municipal waste from the property on which the inhabitants reside and from properties on which cottages or other properties used for recreational and leisure purposes (used only for part of the year) with the frequency established in schedule approved by the Ordering Party. Depending on the reception site and the types of waste, it will be received once or twice a month, once every half year or after a prior telephone application. In addition, the Contractor undertakes to empty baskets at a frequency of not less than once a month. In case of filling the baskets with waste, the Contractor shall be obliged to call the Ordering Party to empty the above baskets. The frequency of receipt of waste in detail is set out in Annex 8 to this SWZ. 3.5. Organisation and maintenance of the municipal selective waste collection point.
3.5.1.The Contractor shall be obliged by 1 January 2022 to organise, equip, maintain and operate the municipal selective collection point for municipal waste. Details are set out in Annex 8 to SWZ.
3.5.2.The costs of the use of waste accepted into the PSZOK will be borne by the Contractor.
3.6. The Contractor shall be obligated to:3.6.1.to produce and submit annual reports together with a photocopy of waste transfer cards confirming how the quantity and type of waste received; 3.6.2.keep records of waste in accordance with the concessions and permits and documentation of waste management as set out in separate regulations; 3.6.3.keeping a system of records of waste transferred to PSZOK (at least the type and quantity of waste transferred, the origin of waste and the transmission of monthly reports detailing the type and quantities accepted waste, on the origin of waste and sites of development); 3.6.4.having an up-to-date authorisation for the activities carried out in the PSZOK, related to waste management and notification of the Contracting Authority of changes to authorisations restricting the performance of accepted commitments; 3.6.5.The Contractor has the obligation to respect environmental and traffic safety regulations during the execution of the order. Fees and penalties for exceeding during the implementation of the standards set out in the relevant environmental regulations will be borne by the Contractor; 3.6.6.6.maintaining continuity of the provision of the service during the period of the contract; 3.6.7.performing the subject matter of the contract in an expert manner, without causing unnecessary nuisance and limiting the inconvenience to the public to the minimum necessary; 3.6.8.bearing full responsibility to the Contracting Authority and third parties for damage to the property and health of third parties arising during and in connection with the implementation of the subject of the contract.3.7. Waste management. The Contractor shall be obliged to use municipal waste in accordance with the guidelines in the detailed description of the subject of the procution.3.8. Equipment the property with bags to collect municipal waste. The Contractor shall be obliged to provide free equipment with bags for selective waste collection.3.9.Schedule for the export of waste. The Contractor shall submit a detailed timetable for the collection of mixed and segregated waste, indicating the localities and dates for the collection of municipal waste. The Contracting Authority undertakes to publish schedules on the Office's website. The Contractor will also be required to distribute other documents related to the waste management system to property owners unless they require confirmation of receipt.
3.10.Reporting. The Contractor is obliged to submit reports and reports.3.11.The quantities of municipal waste are indicative size.3.12.A detailed description of the object of the order is contained in Annex No 8 - Detailed Description of the Order Subject.3.13.Contractor order must provide for all circumstances that may affect the price of the order. Accordingly, it is required of tenderers to verify the conditions for the performance of the order.3.14.it is necessary for tenderers to read in detail the contents of the Order Terms Specification, to obtain all the information necessary for the proper preparation of the offer, and verification and verification of the documentation and promptly inform the Ordering Party of any errors and oversight. 3.15.The Contractor shall not exploit errors or deficiencies in the documentation and shall immediately notify the Contracting Authority, who shall make appropriate changes or corrections.3.16. Information on the Contractor's entrustment of the execution of part of the contract to subcontractors: In this case, the Contractor shall be obliged to demonstrate in the tender form the part of the contract to which the performance of which he intends to entrust to the sub If the necessity to entrust subcontractors with the implementation of some element of the contract arose during the execution of the contract, it requires the procurement of the Contractor.3.18.The Contracting Authority does not provide for the requirements referred to in Article 96 of the Law Pzp. 3.19.The Contracting Authority does not require the submission of tenders in form of electronic catalogues or the attachment of electronic catalogues to the offer, as well as not allowing such possibility.3.20.The language in which offers may be drawn up in the proceedings: English language.3.21.The Ordering Party informs that prior to initiation the procedure does not intend to carry out a vision local. 3.22.Pursuant to Article 95 (1) of the Pzp Act, the Contracting Authority requires employment by the Contractor or subcontractor on the basis of the contract of employment of persons performing the activities indicated by the Contracting Authority, if the performance of these activities consists in the performance of the work in the manner laid down in Article 22 (1) of the Act of 26 June 1974 — Labor Code (i.e., Journal of Laws 2020 item 1320 as amended), i.e. - the activities of the employee responsible for the provision of services, i.e. entitled to drive vehicles, having a driving licence of category C or C+E, in accordance with the act of June 20, 1997, Traffic Law — 5 persons.
- the activities of the employee including coordinating the contractor's tasks in the field of the execution of the contract, in particular the supervision of the proper implementation of the service - 1 person.
- the activities of the employee covering the day-to-day service of residents, in particular the current update of the list of serviced properties and containers, the compilation of reports and settlements — 1 person. This obligation also applies to subcontractors — the contractor is obliged to conclude in each subcontracting contract the relevant records requiring subcontractors to be employed on the employment contract of all persons performing the abovementioned activities. (a) The Contracting Authority requires subcontracting to be submitted within 10 days of the date of the date. signing the contract a written statement (list) of persons addressed to the execution of the contract employed under the employment contract specifying the name of the employee and the scope of the activities. (b) The employment requirement under the employment contract referred to above must be fulfilled throughout the entire period of implementation of the subject of the contract. (c) In case of change of persons during the duration of the contract, the Contractor is obliged to update the statement containing the name indication of the persons designated to perform in/in the actions. (d) The Contractor's failure to submit the statements referred to in points (a) and (c) will be treated as failure to fulfil the obligation to employ workers under an employment contract and will result in contractual penalties set out in the draft contract annexed to SWZ.
(e) In case of reasonable doubt as to the compliance of labour law by the Contractor or Subcontractor, the Contracting Authority may request inspection by the State Labor Inspections
