In the course of the present open procedure, the Landesamt für Zentrale Polizeiliche Dienste Nordrhein-Westfalen intends to conclude a framework agreement with an economic operator for the supply of full protection and civil defence suits as well as pressure distributors (set) for the service dog system of the police of the Land of North Rhine-Westphalia.

The following purchase quantities are planned during the maximum term of the framework agreement:

Zivilschutzanzüge: 55

Druckverteiler (Set): 55

In addition, there are about 120 full protection jackets and 120 civil protection jackets as replacements for worn parts.

The need for replacement may be reduced by repair (sleeves) of full protection and civil protection jackets.

According to case law of the ECJ dated 17.06.2021 _ Case C - 23/20 - the client is obliged to specify a maximum quantity in order to ensure transparency and non-discrimination in competition.

A call-off obligation cannot be derived from this.

The maximum quantity of the attached framework agreement over the maximum duration of four (4) years is quantified as follows:

The framework agreement ends without the need for termination, depending on which event occurs earlier, at the end of the term of the framework agreement (minimum term when the client activates the right of termination, or maximum term if the client does not terminate) or when the maximum quantity is reached.
