The subject of the contract is to carry out filling measurements in public transport vehicles as part of the Comprehensive Traffic Research in the Krakow Metropolitan Area 2023. A detailed description of the subject of the contract is included in the contract template with attachments, constituting Annex 11 to the SWZ.

1. These proceedings are proceeded, in accordance with the Act of 11 September 2019 – Public Procurement Law (i.e. Journal of Laws of 2022, item 1710, as amended), hereinafter referred to as the "Act", in an open tender, using prior evaluation of bids, in accordance with Article 139 of the Act, with the proviso that each Contractor is obliged to submit a statement together with the offer, referred to in points 6.1.8. and 6.1.9. SWZ. 2. The subject of the contract is to carry out filling measurements in public transport vehicles as part of the Comprehensive Traffic Research in the Krakow Metropolitan Area 2023. A detailed description of the subject of the contract is included in the contract template with attachments, constituting Annex 11 to the SWZ. 3. The contracting authority shall not allow partial bids to be submitted. The justification for not dividing the contract into lots is indicated in point 3.4. SWZ. 4. The contracting authority shall not require the performance of the contract by sheltered workshops, social cooperatives or other contractors covered by the provision of Article 94(1) of the Act. 5. Pursuant to Article 95(1) of the Act, the Contracting Authority requires the Contractor (or subcontractor) to employ on the basis of an employment relationship the person in charge of the research, referred to in §10(1) of the contract, i.e. the Project Manager and persons carrying out the measurements (observers). The performance of activities by these persons consists in performing work in the manner specified in Article 22 § 1 of the Act of 26 June 1974 – Labour Code (i.e. Journal of Laws of 2022, item 1510, as amended). The person indicated in §10 clause 1 shall be employed on the basis of an employment relationship throughout the duration of the contract. Observers will be employed on the basis of an employment relationship only for the period of performance by the Contractor of stage 2 of the Subject of the contract. Remark! The above requirement does not apply to bidders: natural persons conducting business activity who undertake to provide services in person and partners of partnerships who undertake to provide services to the company in person 6. The contracting authority provides for the possibility of awarding contracts referred to in Article 214(1)(7) of the Act in the amount not exceeding 50% of the value of the basic contract. These contracts will consist in repeating similar services – in relation to those described in these proceedings in the model contract and annexes to it. The conditions under which the above-mentioned contracts will be awarded will correspond to the conditions set out in this procedure in the model contract and its annexes, but the conditions for participation in the procedure will be limited to the repeated scope of the contract. 7. The Contracting Authority does not provide for an electronic auction. 8. The contracting authority did not conduct preliminary market consultations before initiating the proceedings. 9.The Contracting Authority in these proceedings requires the Contractors to submit the said means of evidence in order to obtain additional points in the bid evaluation criterion referred to in point 20.3. SWZ - on the principles described in point 6.1.2 of the SWZ. 10. The contracting authority, within the limits specified in the provisions of Article 462 et seq. Act, allows for the possibility of performing the subject of the contract by the Contractor with the use of subcontractors. A contractor that intends to subcontract part of a contract shall indicate in its tender the parts of the contract which it intends to subcontract and, if known, the names of any subcontractors. 11. Before the deadline for submitting bids, the Contractor shall pay a bid bond in the amount of PLN 20,000.00 (in words: twenty thousand zlotys) and maintain it continuously until the deadline for binding the offer. The rules for lodging the bid bond are described in point 14 of the SWZ.
