Framework agreement for the temporary transfer of software (licenses Microsoft 365 E3 FSA, Microsoft 365 E3 FUSL, SA SQL Server Standard (SA), SA SQL Server Enterprise (SA)) from a valid Microsoft Enterprise Agreement.
The subject of this tender is a framework agreement for the temporary transfer of software (licenses Microsoft 365 E3 FSA, Microsoft 365 E3 FUSL, SA SQL Server Standard (SA), SA SQL Server Enterprise (SA)) from a valid Microsoft Enterprise Agreement.
The NRW. BANK has the option to extend the subject matter of the contract in accordance with paragraph 1 with licenses Microsoft 365 E5 Upgrade (StepUp E3 to E5), Project Online Plan 3 and/or Visio Online Plan 2. It may exercise this option at any time during the term of the framework agreement by making a unilateral declaration to the Contractor.
The framework agreement is with a company. The NRW. BANK retrieves the required software (licences) from the framework agreement by means of a unilateral declaration in text form or in electronic form. Retrieval is permitted within the term of this Framework Agreement to the extent and for as long as this is compatible with the Enterprise Agreement.
The envisaged contract volume (including optional services) amounts to the following licenses and license quantities (based on the total term of the framework agreement):

g. 150 Project Plan 3 licenses

b. 100 licenses Microsoft 365 E3 FUSL relicensing required (2nd and 3rd year)
c. 500 licenses Microsoft 365 E5 Upgrade (StepUp E3 to E5) 2nd year
d. 1,650 licenses Microsoft 365 E5 upgrade (StepUp E3 to E5) new licenses
e. 12 Lizenzen SA SQL Server Standard (SA)
f. 12 SA SQL Server Enterprise (SA) licenses
g. 150 licenses Visio Plan 2

As of January 1, 2024, the following minimum purchase obligations of NRW. BANK under this Framework Agreement (based on the total duration of the Framework Agreement):

c. 12 Lizenzen SA SQL Server Standard (SA)
d. 12 SA SQL Server Enterprise (SA) licenses
Further minimum purchase obligations of NRW. BANK do not exist.
The individual contracts based on this framework agreement are subject to the following binding maximum purchase limits (based on the total duration of the framework agreement):

b. 1,100 licenses Microsoft 365 E3 FUSL
c. 2,800 Microsoft 365 E5 Upgrade (StepUp E3 to E5)
d. 12 Lizenzen SA SQL Server Standard (SA)
e. 12 SA SQL Server Enterprise (SA) licenses
f. 300 licenses Visio Plan 2
g. 300 Project Plan 3 licenses
The framework agreement starts on 1 January 2024 and runs until 31 December 2026. At the end of 31 December 2026, the framework agreement will automatically end without the need for termination.
