1. The subject of the order is the succession supply of liquid fuels and gas.
2. The subject of the contract consists of three tasks that can be implemented jointly or separately, ie:
Task 1: Liquid fuel supply
Task 2: LPG Liquefied Gas Supply
Task 3: Liquid gas supply in cylinders
Supply of liquid fuelsThe subject of the order is the supply of liquid fuels for:
1) Miejski Zakład Komunikacji Spółka z oo in Koszalin in the amount of:
- diesel fuel - PN-EN 590 in the amount of 3900 m³/the duration of the Agreement;
- unleaded petrol 95 - PN-EN 228 in the amount of 2300 m³/the duration of the Agreement;
- unleaded gasoline 98 - PN-EN 228 in the amount of 146 m³/the duration of the Agreement.
2) Przedsiębiorstwo Gospodarki Komunalnej Spółka z oo in the amount of:
- diesel fuel stored in tanks MZK Sp. z o.o. in Koszalin at 9 Gnienieńska Street - PN-EN 590 in the amount of 600 m³/the duration of the Agreement;
- unleaded petrol 95 stored in tanks MZK Sp. z o.o. in Koszalin at 9 Gnienieńska Street - PN-EN 228 in the amount of 12 m³/the duration of the Agreement;
- diesel fuel stored at a service station located on the territory of the Regional Waste Recovery Plant in Sianów Street Łubuszan 80 - PN-EN 590 in the amount of 185 m³/the duration of the Agreement.
3) Urban Thermal Energy Sp. z o.o.
- diesel fuel stored in tanks MZK Sp. z o.o. in Koszalin at 9 Gnienieńska Street - PN-EN 590 in the amount of 65 m³/the duration of the Agreement;
- unleaded petrol 95 stored in tanks MZK Sp. z o.o. in Koszalin at 9 Gnienieńska Street - PN-EN 228 in the amount of 0.5 m³/the duration of the Agreement;
- unleaded gasoline 98 stored in tanks MZK Sp. z o.o. in Koszalin at 9 Gnienieńska Street - PN-EN 228 in the amount of 5,5 m³/the duration of the Agreement.
The delivered fuels must meet the requirements of the currently applicable Polish Standards:
1) Diesel PN-EN 590
2) unleaded petrol Pb 95 PN-EN 228
3) unleaded petrol Pb 98 PN-EN 228
and quality requirements for motor gasolines and diesel fuels specified in the Regulation of the Minister of Economy of 09.10.2015 on quality requirements for liquid fuels (Journal of Laws 2015, item 1680). Technical and chemical parameters of fuels supplied must not be worse than specified
in the Annexes to the Regulation cited above.
The Employer requires that the Contractor:
1) Delivered the subject of the contract at own cost, to the service stations MZK Spółka z o.o. in Koszalin, at
Gnieźnieńska Street 9 and at Wąwozowa Street 1a and on the territory of the Regional Waste Recovery Plant in Sianowo
Łubuszan Street 80.
2) Autocysterns, equipped with legalized meters and hoses providing encapsulation at sinking
fuel;
3) made deliveries successively, on the basis of an order placed by the Ordering Party, within 2 days
counted from the date of order.
4) The Contractor is obliged to attach a certificate of quality (laboratory judgment) of the supplied fuel to each supply.
Liquefied LPG Gases SupplyThe subject of the contract is the successive supply of liquefied gas (LPG) to the fuel stations of the Municipal Zakładu Komunikacji Spółka z o.o. in Koszalin, in the amount of 1,000,000 liters during the period of the contract.
The liquefied gas (LPG) supplied must:
1) Meet the Polish Standard for Liquefied Gas (LPG): PN-EN 589+A 1:2012 P;
2) Meet the quality requirements for liquefied gas (LPG) set out in the provisions issued pursuant to Article 3 (2) point 3 of the Act of 25 August 2006 on the system for monitoring and controlling fuel quality (Journal of Laws of 2021 item 133 uniform text), and in particular as defined in:
- Regulation of the Minister of Energy of 14 April 2016 on the quality requirements for liquefied gas LPG (Journal of Laws of 2021 item 1293);
- Regulation of the Minister of Economy of 31 January 2007 on the method of sampling of liquefied gas (Journal of Laws of 2007 No. 44 item 279);
- Regulation of the Minister of Energy of 17 January 2017 on methods of testing the quality of liquefied gas LPG (Journal of Laws of 2021, item 2502).
- comply with the amended, in the course of the contract, standards and regulations defining quality requirements.
The Contractor shall indicate the liquefied gas (LPG) producer and/or distributor from which it will acquire liquefied gas (LPG) for resale to the Ordering Party by submitting an appropriate statement. This statement is an element of the offer. If the Contractor is simultaneously a liquefied gas (LPG) producer, it declares that it is a producer of liquefied gas (LPG) and that liquefied gas (LPG) supplied to the Ordering Party comes from its own production. The Contractor shall also submit a declaration that the liquefied gas (LPG) offered is produced in accordance with the standards referred to in paragraph 2 (1) and transported in accordance with the requirements of the specific provisions on the transport of hazardous materials set out in the ADR Agreement, this statement must be annexed to offer.
The Employer requires that the Contractor:
1) Delivered item of order:
(a) satisfying the requirements laid down in the SWZ;
(b) autocysterns equipped with legalised meters and hoses providing encapsulation when sinking LPG liquefied gas;
c) at own cost, at the service stations MZK Spółka z o.o. in Koszalin, at 9 Gnienieńska Street and at 1a Wąwozowa Street.
2) made deliveries successively, on the basis of the order placed by the Ordering Party by email, within 2 working days counted from the date of order.
3) The Contractor is obliged to attach a certificate of quality (laboratory judgment) of the gas supplied to each supply. The quality certificate must contain the results of analyses of parameters specified in the Regulation of the Minister of Energy dated 14.04.2016 (Journal of Laws of 2021 item 1293).
Supply of liquid gas in cylindersThe subject of the contract is the sale, delivery and unloading of liquid gas propane butane in traditional, steel cylinders, quantity of gas in cylinders 11 kg for the propulsion of forklift engines and in the household — quantity of cylinders 2700 pcs during the term of the contract;
1) The Ordering Party will purchase liquid propane butane gas in cylinders for further resale at the Contracting Authority's service stations. The Contracting Authority holds a concession for the marketing of liquid fuels.
2) The cylinders supplied to the Ordering Party are to be properly secured, must not have traces of damage.
3) each cylinder:
(a) it should be labelled in accordance with Polish legislation i.e. it should have a permanent designation i.e.: manufacturer's mark, cylinder factory number, tank capacity in dm3, test overpressure in MPa, full name of gas or gas mixture and chemical formula, date carried out and designated next test of the tank and the technical supervisor's mark, the tare in kg (weight of the vacuum tank without a valve and cap), the gross weight of the tank (mass of the tank with the highest permissible mass of liquid - without cap), net weight of the tank load (maximum permissible mass contained in the fluid tank equal to the product of the tank capacity in dm3 by acceptable proper filling);
- must comply with safety conditions in accordance with European standards and UDT regulations.
4) Propan-butane gas supplied in cylinders should be of good quality, meet the quality requirements set out in standard PN-C-96008, Standard PN-EN 589, Regulation of the Minister of Energy of 14 April 2016 on quality requirements for liquefied gas (LPG) (Journal of Laws 2021, item 1293) and should be deprived of technical and legal defects.
5) Gas packaging or gas cylinder will be exchanged free of charge at each delivery as a removable package, subject to first delivery, on cylinders which the Ordering Party holds.
The Employer requires that the Contractor:
1) made deliveries successively, on the basis of the order placed by the Ordering Party by email, within 4 working days counted from the date of order.
2) Delivered cylinders at own cost, to fuel stations MZK Spółka z o.o. in Koszalin, at 9 Gnienieńska Street and at 1a Wąwozowa Street.
3) lent, for the duration of the contract, suitable containers for storage of cylinders (for each service station one container) meeting the requirements of fire and bhp regulations.
