The subject of the contract is a comprehensive supply of electricity within a period of 12 months, including the sale and provision of electricity distribution services via the distribution network belonging to the Distribution System Operator (hereinafter also DSO) to the facility of the Institute of Physics of the Polish Academy of Sciences.
The commencement of electricity sales will take place after the effective completion of the existing contract for the sale and distribution of electricity.

A detailed description of the subject of the contract, information on the contractual capacity, tariff group, and installed micro-installation are included in Annex 1 to the Terms of Contract Specification (SWZ) – Description of the subject of the contract.
The proposed provisions of the public procurement contract, which will be included in the content of the final public procurement contract, are set out in Annex 8 to the SWZ.
The demand for comprehensive supply of electricity during the contract execution period (12 months) is 7500 MWh.
The value indicated in the paragraph above is an estimated value, which does not reflect the real or declared use of electricity during the term of the contract and in no case may be the basis for any claims on the part of the Contractor.
The contracting authority undertakes to use the energy demand of at least 5000 MWh.
The actual settlements will take place on the basis of current indications of metering and settlement systems for the supply of electricity in accordance with the Contractor's offer. The unit rate per MWh will remain unchanged throughout the duration of the Agreement, subject to section 12 of Chapter III of the Terms of Contract Specification and § 8 of the proposed provisions of the contract (valorisation), while settlements for electricity distribution will take place on the basis of fees resulting from the Tariff for electricity distribution services.
The Contractor is obliged to have, as at the date of commencement and duration of the contract for the provision of the comprehensive service, a comprehensive agreement with the DSO to whose network the Ordering Party's facility is connected, enabling the provision of a comprehensive service for the facility covered by this contract or holding a concession to conduct business activity in the field of electricity distribution issued by the President of the Energy Regulatory Office – in the case of Contractors owning the distribution network
The commencement of electricity sales will take place after the effective completion of the existing contract for the sale and distribution of electricity. The order will be executed from the day following the date of termination of the provision of electricity supply and distribution services to the Ordering Party by the current service provider for a period of 12 months or until the Contractor's remuneration is exhausted. The expected date of commencement of electricity supply is not earlier than 1 December 2023 and no later than 1 January 2024.
The Contractor is obliged to effectively notify the electricity sale agreement to the relevant Distribution System Operator (DSO).
After concluding the contract with the Contractor, the Contracting Authority shall prepare and submit all required
data by the Distribution System Operator (DSO), which will enable the effective change of the seller.
