The subject of the contract is the granting and servicing of a long-term bank loan in the amount of up to PLN 3,750,000 (in words: three million seven hundred fifty thousand) intended to cover the planned budget deficit of 2023, in accordance with Resolution No. LXV/410/2023 of the Białaczów Commune Council of August 29, 2023 regarding: taking a long-term loan to cover the deficit of 2023.

The subject of the contract is the granting and servicing of a long-term bank loan in the amount of up to PLN 3,750,000 (in words: three million seven hundred fifty thousand) intended to cover the planned budget deficit of 2023, in accordance with Resolution No. LXV/410/2023 of the Białaczów Commune Council of August 29, 2023 regarding: taking a long-term loan to cover the deficit of 2023, i.e.:

1. Starting the loan by 27.12.2023. once or in tranches, within no more than 3 days from the submission of the Ordering Party with the application. Credit release means the date of receipt of funds on the account of the ordering party,

2.a long-term loan may not be charged with fees other than interest,

3. Repayment of the loan after the grace period will take place on the last day of the quarter starting from 31/03/2025 to 31/12/2035. in the following installments: 2025 – quarterly 4 installments of PLN 67,000.00, 2026 and 2027 – quarterly PLN 77,000.00,

2028 to 2034 – quarterly PLN 90,402.50, 2035 – quarterly PLN 83,682.50;

If the loan or interest is due on a non-working day, repayment will take place on the first business day after that day.

However, it should be taken into account that this is the maximum date and there is a possibility of early repayment,

4. Interest will be repaid on a monthly basis by the 10th day of the month following the month for which interest is calculated, starting from the date of the loan starting from the starting point of the loan. The Bank will be obliged to calculate interest and send the charge to the Ordering Party no later than 10 days before the interest payment date.

5.A floating rate credit rate consisting of two components:

a) WIBOR rate 1 M with an accuracy of 2 decimal places, which as at 25 September 2023 is 6.05%,

b) fixed throughout the loan period bank's margin determined in % of the loan amount with an accuracy of 2 decimal places,

6.do calculate the interest due, the bank will use the WIBOR 1M rate, calculated as the arithmetic average of all days of the month (i.e. together with days off, where the rate from the previous day applies) and applicable to determine the interest rate starting from the 1st day of the following month. The calculated rate shall be rounded to two decimal places,

7. The loan will be secured by a blank promissory note together with a bank declaration,

8. it is possible not to use the full amount of the loan without incurring additional fees (without commission for the so-called "readiness"),

9. interest will be calculated on the amount of the loan used and not made available,

10. In a situation where the loan is repaid earlier – interest will be calculated until the loan repayment date, and not until the end of the contract period, without compensation commission.

11.do calculation and payment of interest, the year and month shall be assumed to have an actual number of calendar days,

12.interest capitalisation is not allowed,

13. The agreement reserves the possibility of early repayment of the loan or resignation from part of the loan without incurring additional costs resulting from these titles.

14. the loan will be granted on the basis of an agreement proposed by the bank and accepted by the Ordering Party,

15. The Bank will not charge the Ordering Party any commissions or fees in connection with the loan granted during the entire loan period,

16. Information on foreign currencies in which settlements between the Contracting Authority and the Contractor may be conducted: The Contracting Authority does not provide for settlements with the Contractor in foreign currencies.
