Supplied brake calipers must be brand new, of good quality, undamaged, must not have hidden defects and must comply with the description contained in Annex 1 to the SWZ. Remanufactured or assembled parts with reclaimed parts may not be delivered. Supplied calipers as vehicle parts related to the safety of their use and environmental protection are listed in Annex 3 to the Regulation of the Minister of Infrastructure of 31 December 2002 on the technical conditions of vehicles and the scope of their necessary equipment (Journal of Laws of 2016, item 2022, as amended), hence they must meet one of the conditions set out in § 10 of the above-mentioned regulation.
The contracting authority described the subject of the contract by indicating the catalogue number of the vehicle manufacturer, which within the meaning of Article 99 of the PPL is the source of origin. Therefore, the contracting authority allows the submission of an offer for products equivalent to products listed in Annex 1 to the SWZ, which can be replaced, provided that the parts supplied by the Contractor must meet the following general requirements:
a) Ensure unchanged functionality of the system in which it will be mounted;
b) Ensure proper operation and not result in deterioration of reliability and service life in relation to the part indicated by the Ordering Party;
(c) Do not collide with other vehicle components;
d) Meet the technical and operational requirements of the vehicle manufacturer;
e) Have dimensional, assembly and functional parameters in accordance with the parameters of the parts according to the spare parts catalogs of the vehicle manufacturer;
f) Be made of materials (raw materials) that meet the quality and strength requirements of the vehicle manufacturer;
g) It must meet the conditions and technical requirements of brake calipers dedicated to bridges installed in the Ordering Party's vehicles: AVN132, AVN 133, AV132/80, AV132/87, AV133/83 and front axles installed in vehicles: VO 4 /39 CL - 7.5, RL 75 EC, RL 85 A, RL 82 A.
