The subject of the contract is the successive supply of standard diesel oil (summer, transitional, winter) meeting the quality requirements set out in the Regulation of the Minister of Economy of 9 October 2015 on quality requirements for liquid fuels
(Journal of Laws of 2015, item 1680 of 23 October 2015). The Contractor is obliged to refuel diesel fuel into the FM 5000 type ground tanks indicated by the Ordering Party (new designation: BFM05000DG) with a capacity of 5,000 liters and BT 5000 (new designation: BVP05000DG) with a capacity of 5,000 liters owned by the Ordering Party and located at the Ordering Party's headquarters. The estimated demand for diesel fuel for the period covered by the order is 200,000 liters. The purchaser reserves the right to limit delivery to a quantity of at least 100,000 liters. On this account, the Contractor is not entitled to any claims, including damages.
The supplied diesel oil being the subject of the contract must meet the quality parameters specified in detail in the Act of 25 August 2006 on the fuel quality monitoring and control system (i.e. Journal of Laws of 2022, item 1315, as amended), in the Regulation of the Minister of Economy of 9 October 2015 on quality requirements for liquid fuels (Journal of Laws of 2015, item 1680, as amended) and the requirements of the Polish standard PN-EN 590:2022-08 or equivalent. In the event of a change in regulations or standards, the fuel offered must comply with the amended regulations and standards.
4The Ordering Party declares that it does not conduct business activity in the field of generation or trade in fuels and energy within the meaning of Article 32(1)(1) and (4) of the Energy Law Act of 10.04.1997 (consolidated text: Journal of Laws of 2021, item 716, as amended) [hereinafter also referred to as the "Energy Law"].
Diesel fuel must be approved for sale in the European Union.

Deliveries will be provided on working days from 8:00 to 15:00.
Delivery will be provided at the request of the Ordering Party sent by e-mail according to the template constituting Appendix No. 1 to the Agreement – Order.
The Supplier is obliged to provide the Ordering Party with fuel on time (the delivery period of diesel fuel from the notification is one of the criteria for the evaluation of tenders and the Contractor will declare the delivery period in the Offer Form) ........... e-mail, in the amount specified by the Ordering Party, not less than 5 000 liters.
The estimated demand for diesel fuel for the period covered by the order is 200,000 liters.

The price of diesel fuel will be calculated based on the discount indicated in the offer.
Each delivery of diesel fuel must be authenticated by the Contractor with a document regarding the quality of a given batch of fuel, in particular a quality certificate in the original or a confirmed copy.
Release documents as well as copies from quality certificates that are generated electronically and do not require a signature will be honored by the Ordering Party.
The Purchaser reserves the right to take samples of diesel fuel before refuelling.
The receipt of diesel fuel will be confirmed each time by the signature of the delivery protocol by a person authorized by the Ordering Party, this protocol will be the basis for the Contractor to issue an invoice, based on the measurement that will be entered into the protocol from the legalized tank meter.
The Ordering Party requires deliveries by vehicle – tanker with appropriate technical requirements in accordance with ADR regulations, and the delivered fuel must meet all quality requirements in accordance with the Regulation of the Minister of Economy of 9 October 2015 on quality requirements for liquid fuels (i.e. Journal of Laws of 2015, item 1680).
The vehicle to which the deliveries will be made must be equipped with legalized measuring devices measuring the amount of fuel discharge. The measuring device must have valid verification features and a set of undamaged seals affixed by an authorized body.
