Competitive economic appraisal (cross-ownership timber marketing) in the context of a pending lawsuit.
Under the aegis of the Free State of Thuringia, represented by the Thuringian Ministry of Infrastructure and Agriculture - for the Free State of Thuringia and the Landesforstanstalt the task “Competitive economic advice of the Free State and the Landesforstanstalt in the legal defense against an already pending lawsuit for damages because of an alleged violation of the Prohibition of cartels through bundled timber marketing across forest ownership types ”within the framework of an open procedure. The subject of the contract is the competitive economic assessment of all economic issues arising in the proceedings, including the support of the mandated lawyers in drafting written pleadings and as experts in oral negotiations. In terms of the facts and the abundance of data, this is a very complex lawsuit.
The assignment is initially aimed at providing advice in the first instance proceedings and begins immediately with the award of the contract. Should this become necessary after the plaintiff or the defendant client has lodged an appeal, the commissioning can also be extended to work in appeal or appeal proceedings before the higher regional courts or the Federal Court of Justice, including the ECJ, by means of a unilateral declaration by the client.
