1. The subject of the contract is the provision of technical assistance and maintenance services for the STRADOM System.
2. A detailed description of the subject of the contract is contained in the model contract with attachments, constituting Annex 11 to the SWZ.
3. These proceedings are proceeded in accordance with the Act of 11 September 2019 – Public Procurement Law (i.e. Journal of Laws of 2021, item 1129, as amended), hereinafter referred to as the "Act", in the form of an unlimited tender, using the so-called "reverse procedure" described in Article 139 of the Act, with the proviso that each Contractor is obliged to submit a statement together with the offer, referred to in point 6.1.7.
1. The subject of the contract is the provision of technical assistance and maintenance services for the STRADOM System.
2. A detailed description of the subject of the contract is contained in the model contract with attachments, constituting Annex 11 to the SWZ.
3. The Ordering Party shall not allow the submission of partial tenders. The contract cannot be divided into parts for technical, teleological and economic reasons, as it constitutes a coherent whole. The absence of a division into lots does not limit access to the contract for small and medium-sized enterprises, and Contractors operating in the industry covered by the subject of the contract may perform all services and provide the necessary elements.
4. The contracting authority does not require the performance of the contract by sheltered workshops, social cooperatives or other contractors covered by the provisions of Article 94(1) of the Act.
5. Pursuant to Article 95(1) of the Act, the Contracting Authority shall require the Contractor (or a subcontractor) to employ persons on the basis of an employment relationship to perform the activities referred to in § 4(12) of the model contract.
6. The Contracting Authority provides for the possibility of awarding contracts referred to in Article 214(1)(7) of the Act in the amount not exceeding 100% of the value of the basic contract, i.e. PLN 1,455,300.00 net. These contracts will consist in the repetition of similar services – in relation to those described in the present proceedings in the model contract and annexes to it. The conditions under which the above-mentioned contracts will be awarded will correspond to the conditions set out in this procedure in the model contract and its annexes, while the conditions for participation in the procedure will be limited to the repeated scope of the contract.
7. The Contracting Authority shall not permit the submission of variant tenders.
8. The Awarding Entity does not envisage conducting an electronic auction.
9. The Contracting Authority did not conduct preliminary market consultations prior to the initiation of the procedure.
10. The Contracting Authority in this proceeding does not require the Contractors to submit the measures of evidence in question.
11. The Contracting Authority, within the limits laid down by Articles 462 and the following Act, permits the possibility of carrying out the subject of the contract by the Contractor using subcontractors. The Contractor who intends to entrust the execution of part of the contract to subcontractors shall indicate in the offer the parts of the contract to be entrusted to the subcontractors and shall specify the names of possible subcontractors if they are already known.
12. The Contracting Authority shall make available to the Contractors the following documentation, which was created as part of the implementation agreement (documents described in the implementation agreement No. W/II/61/OR/1/2013 of 21.05.2013, and in supplementary agreements: No. W/II/1097/OR/4/2014 of 29.07.2014, No. W/II/17/OR/3/2015 of 16.02.2015 and No. W/II/3195/IT/28/2019 of 29.10.2019). The documentation is attached as Annex 12 to the SWZ.
