This market is a global market with no lots.

In accordance with Article 58 § 1 st , paragraph 2 of the law of 17.6.2016 relating to public procurement, the division into lots that may be awarded separately was considered by the contracting authority, which decided to waive it for the following reasons:

- it is in the interest of the contracting authority to treat its entire insurance portfolio with a single company, which will have a global vision of the client's contracts and the means set up or to be developed to meet the set of needs,

- the statistics of the contracting authority will be analyzed as a whole by the company, with a global vision of the claims, allowing in particular the implementation of prevention plans in connection with different branches,

- the members of the staff of the contracting authority responsible for insurance must be able to clearly identify the company's account manager and establish a long-term global relationship with this person, not broken down according to the type of risk,

- claims management procedures, in particular IT, are easier to know and to apply by members of the personnel of the contracting authority if they are identical for all contracts,

- the contracting authority may for all these reasons make savings in terms of communication with its insurer and training of its staff.

The contracting authority reserves the right not to award the contract.

The market is for insurance contracts covering the following branches:

- part 1: material damage:

1) fire and related perils;

2) all electronic risks;

3) all other material risks;

4) machine breakdown;

5) all risks of exhibitions and works of art,

- part 2: civil liability:

1) general civil liability;

2) agents' civil liability;

3) responsibility of architect / design office;

4) objective civil liability in the event of fire or explosion;

5) civil and school and extracurricular personal injury liability for children and participants in recreational, cultural and sporting activities;

6) bodily injury for the Community House of Neufchâteau - for people in the 3 e age,

- part 3: accidents at work:

1) work accidents;

2) personal injury for members of the Municipal Council,

- component 4: automobile:

1) civil liability, material damage and legal protection;

2) omnium service missions,

- part 5: cyber risks (optional compulsory).

Places where the service is provided: municipal administration of Neufchâteau - Grand'Place nº 1 at 6840 Neufchâteau.

In accordance with the provisions of article 38 §1 a) and c) of the law of 17.6.2016 relating to public contracts, this contract will be passed by competitive procedure with negotiation because on the one hand the needs of the contracting authority cannot be satisfied without adapting immediately available solutions, and on the other hand the contract cannot be awarded without prior negotiations due to circumstances related to its nature, its complexity or because of the risks attached to it ...

The use of this type of procedure is justified by the following elements:

- in law: the contract cannot be awarded without prior negotiations due to special circumstances linked to its nature and complexity,
