1. The subject of the contract is "Extension of the voivodship road No. 747 on the section from the intersection with the national road No. 9 in the town of Warsaw. Iłża to the intersection with the national road No. 79 in the town of Iłża Leipzig – Procedure No 224/23
2. A detailed description of the subject of the Contract can be found in the Tender Documentation (Part IV SWZ) and in the Bill of Quantities - made available only for illustrative purposes (Part V SWZ). The contractor should calculate the value of the works on the basis of the attached design documentation. The bill of quantities is ancillary.
3. Term of the contract: 36 months from the date of signing the contract, including: - 33 months from the date of signing the contract - the deadline for the execution of works; - up to 36 months from the date of signing the contract - the deadline for the implementation of the subject of the contract.

2. The contractor should calculate the value of the works on the basis of the attached design documentation. The bill of quantities is ancillary.
3. The Contractor shall be obliged to ensure, at its own expense, safe traffic and pedestrian conditions in the area of the works covered by the contract on the basis of a traffic organization project, "for the duration of construction" drawn up by and at the expense of the Contractor. The Contractor is obliged to update the project of permanent traffic organization.
4. The scope of construction works covered by the available design documentation should exclude the scope to be implemented by GDDKiA. The scope of these works is presented in the folder called: "GDDKiA scope" placed in part IV of the SWZ.
5. The project has been adapted to the needs of all users, including ensuring accessibility for people with disabilities.
6. If the description of the subject of the contract indicates trademarks, patents or origin, source or a specific process that characterizes the product or services provided by a specific contractor, the Contracting Authority shall allow equivalent solutions.
7. In the case of reference in the description of the subject of the contract to standards, European technical assessments, approvals, technical specifications and technical reference systems, the Ordering Party allows solutions equivalent to those described.
8. The contracting authority provides for the award of contracts referred to in Article 214(1)(7) of the Public Procurement Law up to the total net value of PLN 337,085,972.01.
As part of a similar contract, the following is envisaged:
- preparatory works,
- demolition works,
- earthworks,
- reinforcement of the subsoil,
- drainage of the road body,
- substructures,
- surfaces,
- finishing works,
- traffic safety devices,
- street elements,
- works in the bridge industry,
- robots in the telecommunications industry,
- works in the field of drainage
- robots in the power industry.
- works in the field of rainwater and sanitary sewerage,
- works in the field of tank construction,
- gas network works,
- works in the field of water supply and pipelines,
- works in the field of green management,
- works in the field of pumping station facilities with installations
- works in the field of traffic organization and road safety
- works in the construction and construction industry
The above-mentioned works concern the section on which construction works will be carried out and/or adjacent sections.
9. The Contractor is obliged to have a civil liability insurance policy (OC) for the entire period of the contract and for a guarantee sum not lower than the amount specified in the contract.
10. The Contracting Authority reserves the obligation of the Contractor to personally perform key parts of the contract. The contractor will produce mineral and asphalt mixtures and make: foundations and surfaces from mineral and asphalt mixtures.
Additional information:
The Contracting Authority provides for the application of the so-called reverse procedure referred to in Article 139 (1) of the Pzp Act, i.e. the Contracting Authority shall first examine and evaluate the tenders and then make the qualification of the contractor whose offer has been highest assessed, in the absence of grounds for exclusion, and fulfilling the conditions for participation in the proceedings.
In accordance with Article 257 p.z.p., the Contracting Authority provides for the possibility of rescinding the procedure in question if the public funds which the Contracting Party intended to allocate to the financing of all or part of the contract have not been granted to it.
