Open tender for the supply of IT Hardware Accessories for the needs of the companies of the Ferrovie dello Stato Italiane Group

The contract concerns the supply of IT Hardware Accessories for the needs of the companies of the Ferrovie dello Stato Italiane Group

The Framework Agreement that will be signed with the Successful Bidder will have a basic duration of 24 months from the date of stipulation and a basic amount of a maximum of € 1,750,000.00 (Euro one million seven hundred and fifty thousand / 00), excluding VAT.

The aforementioned Framework Agreement will also provide for the following options that the Contracting Authority reserves the discretionary right to exercise:

• [OPTION OF AMOUNT] the basic amount of the Agreement may be increased, with one or more unilateral acts by the contracting authority, under the same agreements and conditions, for the additional maximum amount of € 450,000.00 (Euro four hundred and fifty thousand / 00) excluding VAT.

• [DURATION OPTION] the basic duration of the Agreement may be extended, with one or more unilateral acts by the Contracting Authority, to the same agreements and conditions, before the expiry of the temporal validity of the same as indicated above, for a maximum of a further 6 (six) months, in the event that the maximum amount established is not exhausted at the expiry of the same.

The two options mentioned above may be exercised either alternately or cumulatively, with one or more acts.

The above options, if exercised, will be communicated to the Contractor by certified e-mail before the Framework Agreement expires.

The Customer also reserves the right to order an extension of the Framework Agreement, pursuant to art. 106, paragraph 11, d.lgs. 50/2016, at the same prices, agreements and conditions, for the time strictly necessary for the conclusion of the procedures for the identification of the new contractor. The applicability of art. 106, Legislative Decree 50/2016, with particular reference to paragraph 12, according to which, if in the course of execution it is necessary to increase or decrease the services up to the fifth of the contractual amount, the Customer may require the contractor to perform under the same conditions provided for in the original Framework Agreement.

With regard to the identification and quantification of security burdens and related D.U.V.R.I. (Determination no. 3/2008 of the A. V.C.P.), in view of the nature of the service, the safety charges related to interference risks are quantified at 0,00 EUR (euro zero/00).

With reference to the maximum total value of the Framework Agreement, it should be noted that the Successful Bidder will have nothing to claim for any reason in respect of the services not requested and consequently not rendered during the execution of the Framework Agreement, in the event that, at the time of expiry of the latter, the maximum amount of the same has not been consumed and whatever the amount of the services requested up to the moment.

It should be noted that the Contract has not been divided into lots, given the uniformity of the supply and the need for centralized management for all the companies of the Ferrovie dello Stato Italiane Group and also taking into account the minimum levels of capacity required by the Call for Tenders aimed at allowing maximum participation in this procedure.
