Conclusion of a non-exclusive discount contract in accordance with Section 130a (8) SGB V on medicinal products containing the active substance sunitinib (ATC code: L01EX01) within the period from 01.02.2022 to 31/01/2024 with the possibility of concluding a contract at any time during the term (“open-house model”).

For the active substance sunitinib (ATC code: L01EX01), the AOK — the health insurance fund for Lower Saxony offers discount contracts to all interested pharmaceutical companies without a selection decision for the period until exclusive contracts come into force as a result of a formal procurement procedure in accordance with the regulations of Part 4 of the GWB. Contracts are concluded within the framework of an “open house model” and act as a bridge between the start of generic competition (patent expiration) and the award of exclusive contracts. The contracts offered are not exclusive; contracts with all market participants (pharmaceutical companies) are desired by AOK Niedersachsen. In the open-house model, uniform conditions apply to all participants. Contract content, conditions and access procedures are uniform — individual negotiations are generally not conducted. The contract terms are a maximum of twenty-four months, the earliest contract start date is 01.02.2022. All contracts end on 31.01.2024 at the latest, regardless of the date of the respective contract conclusion. Joining or concluding a contract can take place on the first of each month within the twenty-four month period. There is a right of termination six weeks to the end of each month. AOK — The health insurance fund for Lower Saxony reserves the right to replace non-exclusive open house discount contracts with exclusive discount contracts even during the contract period. With the entry into force of exclusive discount contracts advertised, the open house contracts are terminated in accordance with the contractual regulations, i.e. the open-house contracts end automatically. According to the experience of AOK Niedersachsen, exclusive discount contracts usually come into force six to eight months after the publication of the relevant tender notice in the supplement to the Official Journal of the European Union. Future contractors in the open house model are asked to regularly inform themselves about these tender notices in the supplement to the Official Journal of the European Union.

Contracts for the active substance sunitinib (ATC code: L01EX01) are concluded for the first time with effect from 01.02.2022. Interested parties who would like to become contractual partners on this date must submit the contract documents to the address specified in the contract documents by 30.12.2021. It depends on access at AOK Lower Saxony. Subsequent contracts are possible on the first of each month during the twenty-four month maximum term. From an organisational point of view, a lead time of usually 35 calendar days is required by the AOK to ensure the necessary work, such as reporting the contract to Lauer-Taxe®. The exact deadlines of receipt will be announced in the contract documents. This publication does not involve the award of a public contract within the meaning of Directive (2014/24/EU) or public procurement law. In order to ensure the greatest possible degree of transparency for the intended conclusion of contracts, they are published in the supplement to the Official Journal of the European Union. In the absence of a corresponding publication form, the contract notice will be used. The resulting conceptual requirements, such as the process name “open procedure”, are solely due to the use of this notice form and the publication platform. This does not entail any further significance, in particular the submission of subprocurement regulations, unless they are mandatory for legal reasons.
