Description:
Supply of ten brand new low-floor two-axle public transport buses in 2020 for PKM, Sp. z o. o. based in Gliwice

The object of the contract includes the delivery of 10 pieces of brand new low-floor two-axle public transport buses, one manufacturer (brand), with an overall length from 11.80 m to 12.20 m (a bus with a tolerance of ± 0.10 m is allowed provided it has approved approval its operation on the Polish market) and total height not exceeding 3.25 m, hereinafter referred to as buses or two-axle buses, which must be of one type, variant and version, which means that they are identical, in particular in terms of construction, technical parameters , completing and equipping, delivered with: repair and maintenance documentation, software licenses and devices necessary to support purchased buses. This order also includes training the Employer's employees in maintenance and repair work.

1. The Purchaser requires that the delivered vehicles meet at least the requirements and conditions set out in the following provisions and standards:

- Directive 2007/46 / EC of the European Parliament and of the Council of 5 September 2007 establishing a framework for the approval of motor vehicles and their trailers and of systems, components and separate technical units intended for such vehicles ("Framework Directive") - OJ UE.L.2007.263.1 of 2007.10.09, hereinafter referred to as Directive 2007/46 / EC - in the scope of requirements for category M3 vehicles,

- Regulation (EC) No 661/2009 of the European Parliament and of the Council of 13 July 2009 on the technical requirements for the type-approval of motor vehicles regarding their general safety, their trailers and systems, components and separate technical units intended for them (Dz. .U.UE.L.2009.200.1 of 2009.07.31), hereinafter referred to as Regulation No. 661/2009 - in the scope of requirements for vehicles of category M3, class I,

- Regulation No. 107 of the United Nations Economic Commission for Europe (UNECE) - Uniform provisions regarding the approval of category M2 or M3 vehicles with regard to their general construction [2015/922] (OJ EU.L.2015.153.1 of 2015.06 .18), hereinafter referred to as Regulation No. 107 EKGONZ - in the scope of requirements for category M3 vehicles of Class I - low-floor - confirmed by the contractor's declaration, contained in point 1.1 of Annex No. 1.1 to the General Terms and Conditions of the contract,

- Regulation of the Minister of Infrastructure of 25 March 2013 on the type-approval of motor vehicles and trailers and their equipment or parts (Journal of Laws 2015.1475 of 2015.09.25, as amended), hereinafter referred to as the Regulation on type-approval - regarding the requirements for category M3 vehicles,

- Ordinance of the Minister of Infrastructure of December 31, 2002 on technical conditions of vehicles and the scope of their necessary equipment (Journal of Laws 2015.305 of 2015.03.05, as amended), hereinafter referred to as the Ordinance on technical conditions - in the scope of requirements regarding category M3 vehicles of Class I, in particular the requirements regarding the permissible dimensions, vehicle masses and axle loads described in Section II of this Regulation.

2. Notwithstanding the above conditions, the Employer requires that the delivered vehicles, meeting the requirements for low-floor buses, set out in Regulation No. 107, have the following additional features:

- the floor intended for standing passengers creates a surface without steps, and direct (i.e. without intermediate steps) access to it from the outside is possible through the first, second and third bus doors,

- no transverse steps on the floor surface in the center aisle inside the vehicle.

3. The Ordering Party requires that buses that meet the requirements of EURO VI standard are delivered.

4. The Employer requires that the offered bus should already be put into serial production.

5. The buses must necessarily have a current "Vehicle Type Approval Certificate" or "EC Vehicle Type Approval Certificate", together with attachments, issued in accordance with applicable regulations and in particular on the basis of the Act of 20 June 1997 - Road Traffic Law ( OJ 2012.1137 of 2012.10.18, as amended) and the Ordinance of the Minister of Infrastructure of 25 March 2013 on the type-approval of motor vehicles and trailers and their equipment or parts (Journal of Laws 2015.1475 of 2015.09.25, as amended).

6. The contracting authority requires that in the said delivery the share of goods originating in the Member States of the European Union or countries with which the European Community has concluded agreements on equal treatment of entrepreneurs amounts to at least 50%. The contracting authority will reject an offer that does not meet this requirement (Article 138c (1) (4) of the Public Procurement Law).
