1. The subject of the contract includes:

1) basic order: comprehensive modernization of street and park lighting, including the replacement of light sources in existing luminaires and the replacement of existing luminaires with LED luminaires in the city of Ostróda;

2) right of option: execution of earthworks when laying cable lines along the existing route (YAKY type), replacing cables and / or restoring the existing cable line - a maximum of 2000m.

1. The subject of the contract includes:

1) basic order: comprehensive modernization of street and park lighting, including the replacement of light sources in existing luminaires and the replacement of existing luminaires with LED luminaires in the city of Ostróda;

2) right of option: execution of earthworks when laying cable lines along the existing route (YAKY type), replacing cables and / or restoring the existing cable line - a maximum of 2000m.

2. A detailed description of the subject of the contract is the functional and utility program (Annex 4 to the SWZ; hereinafter: PFU).

3. The offered luminaires must have an ENEC certificate - a pan-European marking confirming the conformity of the product with the European EN standard on the safety of electrical equipment, and attesting to the quality management system used in production or an equivalent certificate confirming the execution of the luminaire in accordance with European standards program type 5 according to ISO / IEC 17067, granted by a testing laboratory accredited in the European Union.

4. If the description of the subject of the contract contains any trademarks, patent or origin - it should be assumed that the Ordering Party has provided a description with an indication of the type and allows the submission of equivalent offers with technical, operational and functional parameters not worse than those given in the description of the subject of the contract.

5. Right of option:

1) The Contracting Authority provides for the possibility of exercising, depending on the needs, the right of option (optional procurement) referred to in Article 441 of the uPzp;

2) Exercise of the right of option:

a) will consist in the execution of earthworks when laying cable lines along the route of existing ones, replacing cables and / or restoring an existing cable line - a maximum of 2000m;

b) will be preceded by a unilateral statement of the Ordering Party – in writing, specifying the scope of the increase. The basis for determining the contractor's remuneration under the option right will be the unit prices specified in the contractor's offer;

(3) the power referred to in point 2 may be exercised repeatedly until the scope set out in point 2(a) is exhausted;

4) The Ordering Party has the right to exercise the right of option no later than 30 days before the deadline for the performance of the contract;

5) the contractor is obliged to exercise the right of option before the deadline for the performance of the basic contract;

6) the implementation of the subject of the contract within the scope of the right of option will take place in accordance with the requirements specified for the basic contract;

7) the order carried out under the option is a unilateral right of the Ordering Party. Failure by the Ordering Party to exercise the right of option shall not give rise to any claims on the part of the Contractor against the Ordering Party.

6. Reasons for not dividing the contract into lots: The subject of the proceedings is a comprehensive modernization of street and park lighting on LED in Ostróda. The contracting authority did not divide the contract into parts, because such a division would threaten:

1. the proper performance of the contract through difficulties in coordinating the activities of the various economic operators;

2) timely execution of the contract and determination of the entity responsible for the delays occurring;

3) difficulties in enforcing warranty rights, after the performance of the subject of the contract.
