"Purchase of electricity for the needs of the Świdnik Municipality in 2024"

1..The subject of this contract is the supply of electricity for the Municipality of Świdnik and its organizational units for the needs of street lighting and the operation of buildings and premises. 2. A list of collection points together with relevant information on the conditions under which electricity sales services are currently provided and the detailed demand for electricity is attached as Appendix No. 7 to the Terms of Reference – "Detailed description of the subject of the contract" 3. The Contractor is obliged to provide the Contracting Authority/end user with quality standards of service in accordance with the applicable provisions of the Energy Law, in particular the Regulation of the Minister of Economy of 4 May 2007 on the detailed conditions for the operation of the power system (Journal of Laws of 2023, item 819) 4.The supply of energy will take place on the basis of agreements concluded separately by individual end users, the list of which is included in Appendix No. 5 to the Terms of Reference.

3.1. The subject of this contract is the supply of electricity for the Municipality of Świdnik and its organizational units for the purposes of street lighting and operation of buildings and premises.3.2. A list of collection points along with relevant information on the conditions under which electricity sales services are currently provided and the detailed demand for electricity is provided in Appendix No. 7 to the Terms of Reference – "Detailed description of the subject of the contract".3.3. The Contractor is obliged to provide the Contracting Authority with service quality standards in accordance with current market standards and applicable legal acts, including in particular the Regulation of the Minister of Climate and Environment of 22 March 2023 on the detailed conditions for the operation of the power system (Journal of Laws of 2023, item 819).3.4. The supply of energy will take place on the basis of agreements concluded separately by individual End Customers, the list of which is included in Appendix No. 5 to the Terms of Reference – "List of End Users"3.5.The estimated amount of energy supplied in the supply period is 5,723,873 kWh, including: The Contracting Authority declares that the forecast of energy consumption indicated above and in Appendix No. 7 to the Terms of Reference - a detailed description of the subject of the contract is only an approximate value, which, in the course of the performance of the Agreement, may be increased or decreased in relation to the forecasts concerning individual Recipients. The actual energy consumption (lower or higher than the forecast of energy consumption indicated in Appendix 7 to the Terms of Reference) will depend solely on the actual needs of individual end users, however, regardless of the amount of consumption, the Contractor is obliged to apply the energy prices offered in the tender in each case. The Contractor may not pursue any financial claims (e.g. compensation) from the Contracting Authority or the End Users, if during the term of the contract the Contracting Authority or individual End Customers purchase from the Seller a smaller or larger amount of electricity than the forecasted amount of energy indicated in Appendix No. 7 to the Terms of Reference, in particular caused by an increase or decrease in the number of Energy Consumption Points (PPE) for individual Customers, change of tariff group, change of ordered capacity or technical parameters of PPE.3.6. Additional information:The purpose of this joint procurement is to harmonise rates and simplify the rules for accounting for active electricity consumption. The Contracting Authority intends to achieve the above in particular by obtaining a single, fixed price per kilowatt hour, appropriate for individual tariff groups, therefore the offered unit price of electricity must include all additional costs and fees related to the performance of the subject of the contract, including in particular those resulting from commercial balancing or fixed costs of trade fees.

Electricity should meet technical standards in accordance with the provisions of the Energy Law and its implementing regulations and Polish Standards.In the event of failure to meet the quality standards of service, the Contracting Authority is entitled to a discount at the rates specified in the Regulation of the Minister of Energy of 6 March 2019 on the detailed rules for shaping and calculating tariffs and settlements in electricity trading (Journal of Laws of 2022, item 2505) or in any subsequent legal act specifying these rates. A description of the subject matter of the contract can be found in Appendix No. 7 to the Terms of Reference - Detailed description of the subject matter of the contract. Remark!!! For the performance of the subject of the contract in accordance with point 3.4 with the Contractor selected in the tender, separate contracts will be signed by the organizational units of the Municipality of Świdnik in accordance with Appendix No. 5 to the Terms of Reference – List of End Users. In addition, each business unit will cover the costs of energy supply. The Agreement will be concluded in accordance with the template according to Appendix No. 1 and 1A to the Terms of Reference.
