The subject of the contract is the collection of unsorted (mixed) municipal waste (20 03 01) and bio waste constituting municipal waste (20 02 01) from all real estate located within the administrative boundaries of the Mrocza commune (Annex 13 to the ToR) and management of this waste in the municipal installation and collection and management of separately collected municipal waste from all properties located within the administrative boundaries of the Mrocza commune and the Municipal Waste Collection Point in Ostrów. Detailed information related to the subject of the contract can be found in the ToR.
The subject of the contract is the collection of unsorted (mixed) municipal waste (20 03 01) and bio-waste constituting municipal waste (20 02 01) from inhabited real estate, real estate on which residents do not reside, and municipal waste and real estate on which the holiday home is located or other real estate used for recreational and leisure purposes, located in the commune of Mrocza and the management of this waste in a municipal installation as well as the collection and management of separately collected municipal waste from the above-mentioned real estate, as well as from health care, education and culture, public utilities and the Point Selective Municipal Waste Collection in Ostrów. The contractor is obliged to collect directly from the premises of all real estate, as well as from PSZOK and from health care, education and culture as well as public utilities, the following municipal waste fractions:
a) unsorted (mixed) municipal waste,
b) bio waste constituting municipal waste,
c) waste separately collected:
- paper and paperboard and paper and paperboard packaging,
- glass and glass packaging,
- plastics and plastic packaging,
- metal and metal packaging,
- multi-material packaging waste,
- waste electrical and electronic equipment,
- fertilizer bags, silage films, chemicals, used tires
- textiles and clothing,
- waste batteries and accumulators,
- expired medicines
- construction and demolition waste (e.g. debris, post-renovation waste),
- waste not classified as medical waste generated in the household as a result of taking medicinal products in the form of injections and monitoring the level of substances in the blood (e.g. needles and syringes),
- solvents,
- acids,
- alkali,
- devices containing freons,
- edible oils and fats,
- paints, inks, printing inks, binder and resins,
- detergents,
- soil and soil including stones,
- bulky waste,
- marketplace waste.
The contractor will pay fees for the management of unsorted (mixed) municipal waste and bio-waste constituting municipal waste and separately collected municipal waste. In the case of unsorted (mixed) municipal waste and bio-waste constituting municipal waste, these will be fees for the installation in which the waste will be managed. The Contractor is obliged to calculate any potential gains or losses related to the management of municipal waste selectively collected or collected at the price for 1 Mg of individual types of waste collected and used.
A container-bag municipal waste collection system will apply to all properties.
The Employer requires employment by the Contractor or subcontractor under a contract of employment of persons wherever the performance of activities arising from the ToR, including the description of the subject of the contract, necessary to perform the subject of the contract, involves the performance of work within the meaning of art. 22 § 1 of the Act of June 26, 1974, Labor Code (i.e. Journal of Laws of 2018, item 917, as amended).
This requirement applies in particular to persons performing activities related to:
- vehicle drivers,
- persons operating barcode scanners.
The contractor is obliged to include in each subcontract the relevant provisions obliging subcontractors to employ under the employment contract all persons who perform work in the manner specified in art. 22 § 1 of the Code of Civil Procedure
