The subject of the contract includes: Transport of disabled students from the City of Orzesze to specialized educational institutions: (Special School Complex No. 2 in Mikołów, Special School Complex No. 1 in Borowa Wieś, Special School Complex No. 8 in Tychy, Non-public Special Kindergarten "Iskierka" in Tychy, Rehabilitation, Education and Education Center in Wyry, School and Preschool Complex for Deaf and Hard of Hearing Children in Katowice, School and Educational Center for children of the Hearing Impaired and the Blind in Chorzów, Primary School "Horyzont" in Żory, Rehabilitation, Education and Education Center in Żory) and back to the bus stop closest to the student's place of residence, organized on the days of didactic and educational classes from September 4, 2023 to June 21, 2024, includes about 55 disabled students. (if applicable) Wherever there are references to Polish Standards in the documentation of the proceedings, it is permissible to apply the relevant standards of the European Union countries, within the scope adopted by Polish legislation. Wherever trademarks, patents or origin are indicated in the documentation of the materials used, it shall be understood that equivalent materials may be used. The indication of the trade mark, patent or origin is for illustrative purposes only and is used to define the quality standards and class required for the materials used. Where the standards and regulations referred to are national or country- or region-specific, other relevant standards may also apply to ensure an equal or higher level of performance than the standards or regulations cited. By describing the subject of the contract by reference to standards, European technical assessments, approvals, technical specifications and technical reference systems, the Ordering Party allows solutions equivalent to those described. 9. Employment of employees under a contract of employment: pursuant to Article 95 of the Act, the Contracting Authority requires the Contractor or subcontractor to employ persons performing activities in the field of contract performance of the contract on the basis of an employment contract: m.in. The Contracting Authority requires that persons performing activities in the field of contract performance: drivers, dispatcher and guardians are employed under an employment contract. The contractor, subcontractor, further subcontractor performing activities in the field of contract performance is obliged to employ persons under an employment contract, i.e. persons performing activities under this contract, where the performance of these activities consists in performing work in the manner specified in Article 22 § 1 of the Act of 26 June 1974. Labour Code (consolidated text: Journal of Laws of 2020, item 1320, as amended). The Contractor is obliged to ensure that subcontractors and further subcontractors also meet all the requirements for persons employed under an employment contract. The method of verifying the employment of persons, controlling the contractor's compliance with requirements related to employment, sanctions for failure to meet these requirements are described in the model contract annexed to the SWZ.
