Description:
Comprehensive gas supply for the Purchasing Group of the Ropczyce Commune

The subject of the contract is the provision by the Contractor to the Employer of a comprehensive supply of gaseous fuel in the form of high-methane natural gas (Group E), consisting in the sale of gaseous fuel and ensuring the provision of its distribution service, to installations at the Employer's facilities, hereinafter referred to as collection points, the list of which is in Annex 2 to the ToR. SIWZ is published on the Awarding Entity's website www.bip.ropczyce.eu.

1. The subject of the contract is the provision by the Contractor of a comprehensive supply of gaseous fuel in the form of high-methane natural gas (Group E) to the Employer, consisting in the sale of gaseous fuel and ensuring the provision of its distribution service, to installations located in the Employer's facilities, hereinafter referred to as collection points, whose list is included in Annex 2 to the ToR.

2. The total amount of gaseous fuel that will be delivered during the term of the contract to the collection points specified in Annex 2 to the ToR is estimated at 33 909 760 kWh.

3. The volume of gaseous fuel specified in point 2 is an estimated value based on previous consumption. The Employer reserves the right to reduce or increase the total volume of gaseous fuel, relative to the amount specified in point 2. The Contractor shall supply gas during the contract period in an amount corresponding to the actual demand of the Employer, regardless of the estimated consumption forecast. The Contractor shall not be entitled to any claim for failure to collect the expected amount of gaseous fuel by the Employer. A possible change in the estimated consumption set out in point 2 will not result in additional costs for the Ordering Party, except for billing for the amount of gas actually used.

4. The order for gaseous fuel in individual gas months and the contracted capacity order is set out in Annex 2 to the ToR.

5. Comprehensive gas supply will take place under the conditions specified in the provisions of the Act of 10.4.1997 - Energy Law (consolidated text Journal of Laws of 2019, item 755) and in accordance with the Executive Regulations issued to this Act .

6. The service of gaseous fuel distribution to Collection Places will take place via the distribution network belonging to the local DSO - Polska Spółka Gazownictwa Sp. z o. o. based in Warsaw.

7. Requirements for the Contractor.

The Awarding Entity shall grant the power of attorney selected in the proceedings to:

7.1. termination of existing comprehensive contracts for the supply of gaseous fuel, or submission of a statement on termination of comprehensive contracts for the supply of gaseous fuel under the agreement of the Parties,

7.2. submitting, on behalf of the Employer, a comprehensive contract for the supply of gas to the Distribution System Operator in order to implement the concluded comprehensive contract for the supply of gas,

7.3. make all actions and arrangements with DSO and the current seller necessary to carry out the supplier switching procedure and effectively start a comprehensive supply of gas.

8. The quality standards referred to in art. 91 section 2 a:

8.1. in accordance with the Regulation of the Minister of Energy of 24.9.2018 (Journal of Laws of 2018, item 1814) amending the Regulation on the detailed conditions for the functioning of the gas system. The quality standards are set out in particular in Chapter 8 of the Regulation: "Quality parameters of gaseous fuels, quality standards for customer service and how to handle complaints",

8.2. discounts for failure to meet the quality standards of customer service and discounts for failure to meet the quality parameters of gaseous fuels, in accordance with the tariff of OSD Polska Spółka Gazownictwa Sp. z o.o. with its registered office in Warsaw approved by the President of the Energy Regulatory Office on 25.1.2019 by decision No. DRG.DRG-2.4212.50.2018.AIK,

8.3. rebates for failure to meet quality standards of customer service in accordance with the Contractor's tariff.
