2. The order includes the provision of services related to management and investor's supervision along with the author's supervision over the implementation of the contract concluded as a result of a separate procedure for construction works – hereinafter also referred to as the "Contract" or "Task" entitled: "Extension of the provincial road No. 755 from DK 74 to Plażowa Street in the city of Warsaw. Zawichost – stage I"

3. The scope of the contract shall include in particular:

(a) management and coordination of construction operations;

b) providing investor's supervision services over the Contract;

c) exercising author's supervision within the meaning of the provisions of the Construction Law;

(d) verification of design documentation;

(e) compliance with reporting obligations;

4. The detailed scope of the contract is specified in Annex 7 to the SWZ.

2. 3. The scope of the contract shall include in particular:

(a) management and coordination of construction operations;

b) providing investor's supervision services over the Contract;

c) exercising author's supervision within the meaning of the provisions of the Construction Law;

(d) verification of design documentation;

(e) compliance with reporting obligations;

4. The economic operator must ensure supervision of the contract in accordance with

with Polish law, in particular with the Construction Law and the Public Procurement Law.

5. The contracting authority requires that the contract be performed by a team of persons meeting the requirements specified in the procurement documents, including the conditions contained in the construction law, and in particular with the provisions on independent technical functions in construction.

6. The Contract Engineer who is part of the team referred to in paragraph 5 will be the representative of the Contracting Authority and will act within the scope of obligations specified in the Specification of the Terms of Contract (SWZ), Detailed Technical Specification and resulting from the current provisions of the Construction Law, Civil Code, Public Procurement Law, legal acts regulating spending from the Government Road Development Fund and applicable technical standards.

In terms of management and supervision to be provided under this contract, the Contractor is to ensure smooth implementation of the Contract, not exceeding the project budget, timely acceptance of works along with obtaining an occupancy permit and proper future functioning and operation of works by the Contracting Authority. The services to be provided under this agreement are management, supervision and verification of project documentation and control of the Contract in accordance with the Terms of the Contract. These tasks also include administration, coordination of all activities related to the Project, starting from the stage preceding construction, through the stage of conducting works, to the period of guarantee and settlement of the Contract, including supervision over works in accordance with the SWZ and the applicable Polish construction law (as a team of investor's supervision inspectors).

7. The detailed scope of the order and the method of its implementation and method of payment are included in the Description of the Subject of the Order (OPZ), also known as the Detailed Technical Specification (SST), constituting Annex 7 to the SWZ.
