The Federal Joint Committee (G-BA) is the highest decision-making body of the Joint Self-Administration of Doctors, Dentists, Psychotherapists, Hospitals and Health Insurance Funds in Germany. In the form of guidelines, the G-BA determines the catalogue of benefits of the statutory health insurance (GKV) for more than 70 million insured persons and thus determines which medical care services are reimbursed by the GKV. According to § 25a SGB V, the G-BA must also regulate the systematic recording, monitoring and improvement of the quality of these programs in the guidelines on the implementation of organized cancer screening programs (oKFE-RL), taking into account the rights of insured persons to object to the use of their data, and to determine the competent authorities for this purpose.
The subject of this call for tenders is the assumption of the function of a central opposition office already established with the introduction of the organised cancer screening programmes (oKFE-P) and the continuation of the data protection-compliant operation of the central opposition office (https://www.widerspruchsstelle.de). The central opposition office serves exclusively to manage objections lodged by insured persons against the use of data in oKFE-P in accordance with § 25a SGB V. According to § 25a sec. 4 sentence 5 SGB V, insured persons can object to the data processing and use for the purpose of quality assurance of oKFE-P. Objections received will be received by the central opposition body and stored together with the data necessary for the management of the objections. The information that an objection exists is transmitted by the central opposition office to the trust office of the G-BA (https://www.vertrauensstelle-gba.de) for further consideration. This ensures that data from insured persons who have objected are not used to assess the quality of the oKFE-P (programme assessment).
The G-BA's early detection programmes that are relevant for the central opposition body at the time of award are the organised cancer screening programmes (oKFEP) for colorectal cancer and cervical cancer.
