Description:
Purchase of mobile equipment — Expansion of the Jarocin Waste Management Plant — tractor

1. The subject of the order is delivery for “Waste Management Plant” Sp. z o.o. in Jarocin — Wielkopolskie Centre for Recycling of a saddle tractor. The object of the order is to be delivered to the headquarters of the Ordering Party (Witaszyczki, Mariusz Małynicza Street 1, 63-200 Jarocin).

2. For a detailed description of the item of the order, see Annex 8 to the SWZ.

3. The undertaking is implemented as part of the project “Expansion of the Jarocin Waste Zoning Plant — Wielkopolskie Recycling Centre” - the agreement for funding no POIS.02.02.00-00-0004/19-00 under action 2.2. Municipal Waste Management Priority Axis II Environmental Protection, including adaptation to climate change of the Infrastructure and Environment Operational Programme 2014-2020.

6. The Contracting Authority shall not allow the submission of partial tenders.

7. The Contracting Authority shall not permit the submission of variant tenders and in the form of electronic catalogues.

8. The Contracting Authority shall not provide for the award of contracts referred to in Article 214 (1) (8) p.z.p.

9. The Contractor is obliged to use only factory-new materials with valid relevant required certificates

and certificates and admissions confirming the possibility of applying them to the performance of this contract.

10. In accordance with Article 101 (4) of the PZP, the Contracting Authority allows solutions equivalent to those described in the SWZ by means of standards, technical assessments, technical specifications

and the technical reference systems referred to in Article 101 (1) (2) and paragraph 3 of the PZP, if they allow to obtain characteristics or parameters no worse than those cited.

11. In accordance with Article 101 (5) of the PZP, the Contractor who invokes equivalent solutions described by the Contracting Authority shall prove in the tender that the proposed solutions satisfy the requirements set out in the description of the subject of the contract.

12. Whenever the SWZ indicates a trademark of a material, patent or origin, source or specific process that characterizes the products or services provided by a particular contractor, the Contractor may use indicated or equivalent other material that meets the technical requirements indicated by Ordering man. Whenever this specification describes the subject of the order by means of standards, approval, technical specifications and reference systems, the Contracting Authority shall allow solutions equivalent to that described. A Contractor who invokes equivalent solutions described by the Contracting Authority shall demonstrate that the construction works offered by him meet the requirements laid down by the Contracting Authority. Equivalent solutions shall mean solutions that guarantee parameters no worse than specified in the SWZ. A Contractor who invokes equivalent solutions described by the Contracting Authority shall demonstrate that the works or materials offered by him meet the requirements laid down by the Contracting Authority. Acceptance of equivalent materials on the part of the Contracting Authority shall be carried out in writing on the basis of documents submitted by the Contractor (catalogue cards or other documents) proving their equivalence.

13. NOTE: For each standard set up in the SWZ, including the national standard, the Contracting Authority authorises the application of an equivalent standard. Thus, any phrase in the SWZ relating to the standard, standard, approval, material, patent or trade mark shall be read with an accompanying note “or equivalent”, taking into account the guidelines indicated in the SWZ and the requirements for the equivalence parameters.
