Successive delivery of disposable equipment for SP ZOZ in Siemiatycze

1. The subject of the contract is the successive delivery of a single-use assortment, as described in Annex 2 to the Terms of Reference, divided into 68 packages. – Assortment – quantity – price forms. 2. A detailed description of the subject of the contract, a list of the required limit parameters covered by the delivery listed in paragraph 1 shall include an assortment and quantity form with a description, constitute Annex 2 to the Terms of Reference in detail to the offer, constituting an integral part of it, and then an integral part of the delivery contract. 3. The Contractor is obliged to perform the order on the terms and conditions described in the model delivery contract constituting Annex 3 to the Terms of Reference. 4. The quantity of Goods specified in the SWZ, intended for purchase during the term of the Agreement, has been determined in an estimated manner. The quantity of Goods purchased by the Ordering Party during the term of the Agreement may be smaller or increase and on this account the Contractor shall not be entitled to any claims against the Ordering Party, provided that the Ordering Party acquires Goods with a value not lower than 60 % 5. The contracting authority requires that the assortment offered in this public procurement procedure, within the scope of the submitted offer, meets the conditions and has the necessary marking, certificates, declarations of conformity placing on the market and use in the territory of a Member State, referred to in the Act of 20 May 2010 on medical devices (Journal of Laws of 2021, item 1565, i.e. 6. The Contracting Authority requires that the products offered in this public procurement procedure, within the scope of the submitted offer, meet certain standards, have current safety data sheets and current entries in the Register of Chemical Agents and Medical Materials allowing for marketing and use on the territory of the Republic of Poland, referred to in the Act of 6 September 2001 Pharmaceutical Law (Journal of Laws of 2021.poz 1977 i.e. j) 7. The period of validity of the delivered Goods may not be shorter than 12 months from the date of receipt of the delivery of the Goods, deliveries of products with a shorter validity period may be allowed in exceptional situations, each time consent to them must be given by an authorized representative of the Ordering Party. 8. The Contractor should submit a tender in accordance with the price form (Appendix No. 2). 9. The Contractor is obliged to indicate in the offer form – Appendix No. 1 – those items of the contract whose performance it intends to entrust to subcontractors. (applies/does not apply). 10. Arrangements and decisions regarding the performance of the contract shall be agreed by the Ordering Party with the appointed representative of the Contractor. 11. The Ordering Party shall not be liable for damages caused by the Contractor during the performance of the subject of the contract. 12. If in the description of the subject of the contract - specified in Appendix No. 2 - there is any trademark patent, standard or origin, it should be assumed that the Ordering Party has provided such a description with an indication of the type and allows the submission of equivalent offers with parameters not worse than those given under the concept of type. At the same time, we would like to remind you that in accordance with Article 95(5) of the Public Procurement Law, the Contractor who refers to solutions equivalent to those described by the Ordering Party is obliged to demonstrate that the subject of the contract offered by him meets the requirements specified by the Ordering Party.
